Poisons Amendment (Savings) Regulations 2009

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

1.   Short title

These regulations may be cited as the Poisons Amendment (Savings) Regulations 2009 .

2.   Commencement

These regulations are taken to have taken effect on 1 January 2009.

3.   Principal Regulations

In these regulations, the Poisons Regulations 2008 are referred to as the Principal Regulations.

4.    Regulation 98 inserted

After regulation 97 of the Principal Regulations , the following regulation is inserted in Part 6:

98.   Savings provision

(1)  An approval, authorisation, authority, licence, permit or other similar instrument issued or granted under the Poisons Regulations 2002 and in force immediately before the commencement of these regulations is taken to have been issued or granted under these regulations.
(2)  An authority issued or granted under the Poisons Regulations 1975 and in force immediately before the commencement of the Poisons Regulations 2002 is taken to have been issued or granted under these regulations.

5.   Legislation rescinded

The legislation specified in Schedule 1 is rescinded.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations –
(a) amend the Poisons Regulations 2008 by inserting, with retrospective effect, a savings provision in respect of approvals, authorities, permits and similar instruments issued or granted under regulations that have been rescinded; and
(b) rescind certain amendment regulations.
