Water Management (Watercourse Authority Exemption) Order 2009

I make the following order under section 123G(1) of the Water Management Act 1999 .

1.   Short title

This order may be cited as the Water Management (Watercourse Authority Exemption) Order 2009 .

2.   Commencement

This order takes effect on the day on which the provisions of the Water Legislation Amendment Act 2008 commence.

3.   Interpretation

The Acts Interpretation Act 1931 applies to the interpretation of this order as if it were regulations within the meaning of that Act.

4.   Exemption

It is declared that Part 6A of the Water Management Act 1999 does not apply to the following water entities:

(a) the following authorities under Division 4 of Part 3 of the Local Government Act 1993 :

(i) Cradle Coast Water Authority;

(ii) Esk Water Authority;

(iii) Hobart Water Authority;

(b) the following bodies corporate under the Corporations Act:

(i) Cressy Longford Irrigation Scheme Ltd. (ACN 097 994 100);

(ii) Shannon Clyde Water Company Ltd. (ACN 132 740 437);

(iii) Tasmanian Water and Sewerage Corporation (Northern Region) Pty. Ltd. (ACN 133 655 062);

(iv) Tasmanian Water and Sewerage Corporation (North-Western Region) Pty. Ltd. (ACN 133 655 008);

(v) Tasmanian Water and Sewerage Corporation (Southern Region) Pty. Ltd. (ACN 133 654 976);

(c) the following councils:

(i) Break O'Day Council;

(ii) Burnie City Council;

(iii) Central Coast Council;

(iv) Central Highlands Council;

(v) Circular Head Council;

(vi) Derwent Valley Council;

(vii) Dorset Council;

(viii) Flinders Council;

(ix) Glamorgan-Spring Bay Council;

(x) Huon Valley Council;

(xi) Kentish Council;

(xii) King Island Council;

(xiii) Launceston City Council;

(xiv) Meander Valley Council;

(xv) Northern Midlands Council;

(xvi) Southern Midlands Council;

(xvii) Waratah-Wynyard Council;

(xviii) West Coast Council;

(d) the Director of Inland Fisheries;

(e) the following Government Business Enterprises:

(i) Hydro-Electric Corporation;

(ii) Rivers and Water Supply Commission;

(f) the Elizabeth Macquarie Irrigation Trust, a trust established under Part 10 of the Water Management Act 1999 .
