Property Agents and Land Transactions Amendment Regulations (No. 2) 2008

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Property Agents and Land Transactions Act 2005 .

1.   Short title

These regulations may be cited as the Property Agents and Land Transactions Amendment Regulations (No. 2) 2008 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Date of effect

For the purposes of section 82(8) of the Property Agents and Land Transactions Act 2005 , the prescribed date from which this amendment to the Code of Conduct is to have effect is 17 December 2008.

4.   Principal Regulations

In these regulations, the Property Agents and Land Transactions Regulations 2006 are referred to as the Principal Regulations.

5.    Schedule 2 amended (Code of Conduct)

Schedule 2 to the Principal Regulations is amended by omitting paragraph (a) from clause 9 of Part 3 and substituting:
(a) must not erect a sign –
(i) if erected on private property other than the property being sold, that has not been authorised by the owner of the property on which the sign is erected; or
(ii) that contravenes any applicable law, regulation, by-law or planning scheme; and

Displayed and numbered in accordance with the Rules Publication Act 1953.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Property Agents and Land Transactions Regulations 2006 by –
(a) amending the Code of Conduct for property agents to allow a property agent to erect a sign on private property in certain circumstances; and
(b) prescribing 17 December 2008 as the date from which the amendment takes effect.
