Poisons Amendment Regulations 2008

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

1.   Short title

These regulations may be cited as the Poisons Amendment Regulations 2008 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Poisons Regulations 2002 are referred to as the Principal Regulations.

4.    Regulation 69 amended (Prescription, &c., of certain substances prohibited, unless authorised by Secretary)

Regulation 69(1) of the Principal Regulations is amended by inserting after paragraph (l) the following paragraph:
(la) sitaxentan;

5.    Regulation 70 amended (Precautions in prescribing substances capable of producing birth defects)

Regulation 70 of the Principal Regulations is amended as follows:
(a) by inserting in subregulation (1) "sitaxentan," after "etretinate,";
(b) by inserting in subregulation (2)(a) "sitaxentan," after "etretinate,";
(c) by inserting in subregulation (2)(b)(ia) "or sitaxentan" after "bosentan".

6.    Regulation 87 amended (Labelling of dispensed medicines)

Regulation 87(3) of the Principal Regulations is amended as follows:
(a) by inserting in paragraph (e) "sitaxentan," after "isotretinoin,";
(b) by inserting the following paragraph after paragraph (g) :
(ga) where the medicine is dienestrol, a warning statement in the form, or to the effect, of warning statement 67 in Part 1 of Appendix F to the Uniform Standard;

7.    Schedule 5 amended (Substances not to be supplied without approved information sheet)

Schedule 5 to the Principal Regulations is amended by inserting after item 4 the following item:
4A.   Sitaxentan.

8.    Schedule 7 amended (Class 1 substances)

Schedule 7 to the Principal Regulations is amended as follows:
(a) by inserting the following item after item 1 :
1AA.   Apraclonidine.
(b) by inserting the following items after item 1B :
1C.   Betaxolol.
1D.   Bimatoprost.
1E.   Brimonidine.
1F.   Brinzolamide.
1G.   Carbachol.
(c) by inserting the following items after item 2C :
2D.   Dipivefrin.
2E.   Dorzolamide.
(d) by inserting the following items after item 6 :
6A.   Latanoprost.
6B.   Levobunolol.
(e) by inserting the following item after item 10 :
10A.   Pilocarpine.
(f) by inserting the following item after item 13 :
13A.   Timolol.
(g) by inserting the following item after item 14 :
14A.   Travoprost.

These regulations are administered in the Department of Health and Human Services.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Poisons Regulations 2002 by –
(a) providing that a person must comply with certain requirements before prescribing, selling or supplying sitaxentan; and
(b) providing that containers holding dienestrol or sitaxentan are to be labelled with suitable warnings; and
(c) prescribing certain substances as class 1 substances for the purposes of section 38(1) of the Poisons Act 1971 .
