Food Amendment Regulations 2008
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Food Act 2003 .

These regulations may be cited as the Food Amendment Regulations 2008 .
These regulations take effect on the day on which their making is notified in the Gazette.
In these regulations, the Food Regulations 2003 are referred to as the Principal Regulations.
4. Regulation 4A inserted
After regulation 4 of the Principal Regulations , the following regulation is inserted:4A. Modification of Food Standards Code
Notwithstanding regulation 4, the incorporation of the Food Standards Code in these regulations has effect as if Standard 3.3.1 of that Code were modified by inserting after clause 3(2) the following subclause:(3) Despite subclause (1), clause 3 of Standard 3.2.1 is to be read as not requiring a person who at 5 October 2008 is carrying on a food business to which this Standard applies to implement or comply with a food safety program until 1 June 2009.
The amendment to the Principal Regulations effected by regulation 4 of these regulations expires 12 months after the day on which it takes effect and, on that expiry, the Principal Regulations have effect as if that regulation had not been made.

These regulations amend the Food Regulations 2003 by deferring, from 5 October 2008 to 1 June 2009, the implementation in Tasmania of the provisions of the Food Standards Code relating to the processing of food for service to vulnerable persons.
