Landslip (Wynyard) Amendment Order 2008

On the recommendation of the Director of Mines, I make the following order under section 161D(1)(b) of the Mineral Resources Development Act 1995 .

1.   Short title

This order may be cited as the Landslip (Wynyard) Amendment Order 2008 .

2.   Commencement

This order takes effect on the thirtieth day after the day on which its making is notified in the Gazette.

3.   Principal Order

In this order, the Landslip (Wynyard) Order 1975 is referred to as the Principal Order.

4.    The Schedule amended (Landslip Areas)

The Schedule to the Principal Order is amended as follows:
(a) by omitting the heading and substituting the following heading:
Landslip Areas at Boat Harbour
(b) by omitting Parts I and II and substituting the following Parts:
PART I - A Landslip Area
The areas coloured orange on Land District Plans 382 and 383* in the office of the Director-General of Lands at Hobart, as varied by –
(a) including the 3 areas shown as Area 1 on Plan 8181 in the Central Plan Register, a reduced copy of which is set out, by way of illustration only, in Schedule 2 to this order; and
(b) excluding, and recategorising as B landslip area, the area shown as Area 2 on that Plan; and
(c) excluding the 2 areas shown as Area 3 on that Plan.
PART II - B Landslip Area
1.   The areas coloured green on Land District Plans 382 and 383* in the office of the Director-General of Lands at Hobart.
2.   The area shown as Area 2 on Plan 8181 in the Central Plan Register, a reduced copy of which is set out, by way of illustration only, in Schedule 2 to this order.

*Note: Land District Plans 382 and 383 are registered in the Central Plan Register as Plans 8127 and 8128 respectively.

5.    Schedule 2 inserted

After Schedule 1 to the Principal Order , the following Schedule is inserted:

EXPLANATORY NOTE

(This note is not part of the order)

This order amends the Landslip (Wynyard) Order 1975 by adjusting the areas declared to be an A landslip area and a B landslip area, near Boat Harbour, in the municipal area of Waratah-Wynyard.
