Fisheries (General and Fees) Amendment Regulations 2008

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Living Marine Resources Management Act 1995 .

1.   Short title

These regulations may be cited as the Fisheries (General and Fees) Amendment Regulations 2008 .

2.   Commencement

These regulations take effect on 1 July 2008.

3.   Principal Regulations

In these regulations, the Fisheries (General and Fees) Regulations 2006 are referred to as the Principal Regulations.

4.    Schedule 1 amended (Licence fees)

Part 1 of Schedule 1 to the Principal Regulations is amended as follows:
(a) by omitting paragraph (b) from item 2 and substituting the following:
 

(b) Transfer

 
 

(i) for a period not exceeding 2 years (whether or not the transfer includes all licences specified on the fishing certificate)

100 fee units

 

(ii) to comply with a court order (whether or not the transfer includes all licences specified on the fishing certificate)

100 fee units

 

(iii) in settlement of an estate (whether or not the transfer includes all licences specified on the fishing certificate)

100 fee units

 

(iv) if parties to the transfer are persons "related by family" within the meaning of section 7 of the Relationships Act 2003 (whether or not the transfer includes all licences specified on the fishing certificate)

100 fee units

 

(v) in all other cases

1 500 fee units

(b) by omitting paragraph (g) from item 19 and substituting the following:
 

(g) Fishing licence (banded morwong)

 
 

(i) renewal

340 fee units plus 10 fee units per banded morwong quota unit

 

(ii) transfer

250 fee units

 

(iii) permanent transfer of banded morwong quota units, per application

100 fee units

 

(iv) variation (seasonal quota transfer)

50 fee units

(c) by inserting after subparagraph (ii) in paragraph (j) of item 19 the following:
 

(k) Fishing licence (southern calamari)

 
 

(i) renewal

510 fee units

 

(ii) transfer

250 fee units

5.    Schedule 2 amended (Miscellaneous fees)

Schedule 2 to the Principal Regulations is amended by omitting item 6 and substituting:

Purchase of tags for tagging rock lobster –

 
 

(a) horn tag – per tag

0.28 fee units

 

(b) tail tag – per tag

0.55 fee units

 

(c) meat only – per tag

0.35 fee units

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Fisheries (General and Fees) Regulations 2006 by –
(a) prescribing the renewal and transfer fees for fishing licences (southern calamari); and
(b) prescribing the renewal and quota unit transfer fees for fishing licences (banded morwong); and
(c) updating the circumstances in which the concessional fee is available on transfer of a fishing licence (vessel); and
(d) reducing the fees payable for the purchase of rock lobster tags.
