Sentencing Amendment Regulations 2008

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Sentencing Act 1997 .

1.   Short title

These regulations may be cited as the Sentencing Amendment Regulations 2008 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Interpretation

In these regulations –

Act means the Sentencing Act 1997 .

4.   Principal Regulations

In these regulations, the Sentencing Regulations 1998 are referred to as the Principal Regulations.

5.    Regulation 3A inserted

After regulation 3 of the Principal Regulations , the following regulation is inserted:

3A.   Extension of Part 3A of Act

For the purposes of section 27Y of the Act, 31 July 2008 is prescribed.

These regulations amend the Sentencing Regulations 1998 by prescribing 31 July 2008 as the cut-off date for the making of drug treatment orders under Part 3A of the Sentencing Act 1997 .
