Marine and Safety (Infringement Notices) Regulations 2008

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Marine and Safety Authority Act 1997 .

1.   Short title

These regulations may be cited as the Marine and Safety (Infringement Notices) Regulations 2008 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Interpretation

In these regulations –
Act means the Marine and Safety Authority Act 1997 .

4.   Offences under Marine and Safety (Safe Operation) Regulations 2003

(1)  For section 45(1) of the Act, an offence against a provision of the Marine and Safety (Safe Operation) Regulations 2003 specified in column 1 of Schedule 1 is a prescribed offence.
(2)  The penalty specified in column 2 of that Schedule opposite that provision is the penalty payable under an infringement notice served in respect of that offence.

5.   Offences under Marine and Safety (Collision) Regulations 2007

(1)  For section 45(1) of the Act, an offence against a provision of the Marine and Safety (Collision) Regulations 2007 specified in column 1 of Schedule 2 is a prescribed offence.
(2)  The penalty specified in column 2 of that Schedule opposite that provision is the penalty payable under an infringement notice served in respect of that offence.

6.   Offences under Marine and Safety (Maritime Incidents) Regulations 2007

(1)  For section 45(1) of the Act, an offence against a provision of the Marine and Safety (Maritime Incidents) Regulations 2007 specified in column 1 of Schedule 3 is a prescribed offence.
(2)  The penalty specified in column 2 of that Schedule opposite that provision is the penalty payable under an infringement notice served in respect of that offence.

7.   Offences under Marine and Safety (Pilotage and Navigation) Regulations 2007

(1)  For section 45(1) of the Act, an offence against a provision of the Marine and Safety (Pilotage and Navigation) Regulations 2007 specified in column 1 of Schedule 4 is a prescribed offence.
(2)  The penalty specified in column 2 of that Schedule opposite that provision is the penalty payable under an infringement notice served in respect of that offence.

8.   Offences under Marine and Safety (Safety Manning) Regulations 2007

(1)  For section 45(1) of the Act, an offence against a provision of the Marine and Safety (Safety Manning) Regulations 2007 specified in column 1 of Schedule 5 is a prescribed offence.
(2)  The penalty specified in column 2 of that Schedule opposite that provision is the penalty payable under an infringement notice served in respect of that offence.

9.   Legislation rescinded

The legislation specified in Schedule 6 is rescinded.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations –
(a) prescribe certain regulatory offences under the Marine and Safety Authority Act 1997 as offences for which infringement notices may be issued; and
(b) prescribe the penalties for those infringement notice offences; and
(c) rescind the Marine and Safety (Prescribed Offences) Regulations 1998 .
