Sullivans Cove Waterfront Authority Amendment Regulations 2007

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Sullivans Cove Waterfront Authority Act 2004 .

1.   Short title

These regulations may be cited as the Sullivans Cove Waterfront Authority Amendment Regulations 2007 .

2.   Commencement

These regulations take effect on the seventh day after the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Sullivans Cove Waterfront Authority Regulations 2005 are referred to as the Principal Regulations.

4.    Regulation 8 amended (Waiver, reduction or refund of fees)

Regulation 8(1)(a) of the Principal Regulations is amended by omitting "commenced" and substituting "completed".

5.    Schedule 1 amended (Fees)

Schedule 1 to the Principal Regulations is amended as follows:

(a) by omitting from clause 1 of Part 2 "planning";

(b) by omitting from clause 1(a) of Part 2 "75 fee units" and substituting "120 fee units";

(c) by omitting from clause 2 of Part 2 "planning";

(d) by omitting from clause 2(a) of Part 2 "75 fee units" and substituting "50 fee units";

(e) by omitting from clause 2(b) of Part 2 "250 fee units" and substituting "165 fee units";

(f) by omitting from clause 3 of Part 2 "455 fee units" and substituting "660 fee units";

(g) by omitting from clause 4 of Part 2 "200 fee units" and substituting "165 fee units";

(h) by omitting from clause 5 of Part 2 "75 fee units" and substituting "120 fee units";

(i) by omitting from clause 6 of Part 2 "200 fee units" and substituting "165 fee units";

(j) by inserting the following clauses after clause 6 in Part 2 :

7.   Approval of subdivision plan

Application under section 81(2) of the Local Government (Building and Miscellaneous Provisions) Act 1993 for approval of subdivision plan –

(a) 210 fee units; and

(b) 80 fee units for each proposed new lot specified on the subdivision plan.

8.   Extension of permit

Granting under section 53(5A) of the Land Use Planning and Approvals Act 1993 of extension  – 120 fee units.

(k) by omitting clause 1 from Part 3 and substituting the following clause:

1.   Building permit

Application under the Building Act 2000 for building permit (other than temporary occupancy permit) –

(a) where the application is in respect of works involving demolition  – 60 fee units for each hour spent in assessing the application (with a minimum fee of 120 fee units); or

(b) in any other case –

(i) where the cost of the works is less than $5 000  – 60 fee units; or

(ii) where the cost of the works is $5 000 or more  – 120 fee units.

(l) by inserting the following clauses after clause 2 in Part 3 :

3.   Permit to proceed

Application under section 178(2) of the Building Act 2000 for permit to proceed with building work –

(a) where the cost of the building work is less than $5 000  – 60 fee units; or

(b) where the cost of the building work is $5 000 or more  – 120 fee units.

4.   Permit of substantial compliance

Application under section 186(2) of the Building Act 2000 for permit of substantial compliance –

(a) where the cost of the building work is less than $5 000  – 60 fee units; or

(b) where the cost of the building work is $5 000 or more  – 120 fee units.

(m) by omitting from clause 1(a) of Part 4 "works does not exceed $5 000" and substituting "plumbing work is less than $5 000";

(n) by omitting paragraph (b) from clause 1 of Part 4 and substituting the following paragraphs:

(b) where the cost of the plumbing work is more than or equal to $5 000 but less than $12 000 – 165 fee units; or

(c) where the cost of the plumbing work is more than or equal to $12 000 but less than $25 000 – 250 fee units; or

(d) where the cost of the plumbing work is more than or equal to $25 000 but less than $50 000 – 370 fee units; or

(e) where the cost of the plumbing work is more than or equal to $50 000 – 60 fee units for each hour spent in assessing the application (with a minimum fee of 410 fee units).

(o) by inserting the following clauses after clause 1 in Part 4 :

2.   Special plumbing permit

Application under section 79(1) of the Building Act 2000 for special plumbing permit – 120 fee units.

3.   Variation to plumbing or special plumbing permit

(1) Application under regulation 20(1) of the Plumbing Regulations 2004 for variation of plumbing permit or special plumbing permit – 120 fee units.

(2) Application under regulation 20(2) of the Plumbing Regulations 2004 for variation of special plumbing permit – 120 fee units.

(p) by omitting from clause 1 of Part 5 "80 fee units" and substituting "33 fee units";

(q) by omitting from clause 3 of Part 5 "200 fee units" and substituting "250 fee units";

(r) by inserting the following clause after clause 5 in Part 5 :

6.   Dealing with heritage works application

Dealing under section 33 of the Historic Cultural Heritage Act 1995 with works application – 40 fee units.
