Radiation Protection Amendment Regulations 2007

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Radiation Protection Act 2005 .

1.   Short title

These regulations may be cited as the Radiation Protection Amendment Regulations 2007 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Radiation Protection Regulations 2006 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3 of the Principal Regulations is amended as follows:
(a) by inserting the following definition after the definition of carrier :
CEO of ARPANSA means the Chief Executive Officer of ARPANSA appointed under section 45 of the Australian Radiation Protection and Nuclear Safety Act 1998 of the Commonwealth;
(b) by omitting "chief executive officer" from paragraph (b) of the definition of effective dose and substituting "CEO";
(c) by omitting "chief executive officer" from paragraph (b) of the definition of equivalent dose and substituting "CEO";
(d) by omitting "chief executive officer" from the definition of NDRP and substituting "CEO";
(e) by omitting "6" from the definition of NHMRC and substituting "5B";
(f) by omitting "chief executive officer" from the definition of Safe Transport Code and substituting "CEO";
(g) by omitting "chief executive officer" from paragraph (a) of the definition of weighted equivalent dose and substituting "CEO".

5.    Regulation 8 amended (Information to be contained in radiation management plans)

Regulation 8(3)(f) of the Principal Regulations is amended by omitting "chief executive officer" and substituting "CEO".

6.    Regulation 52A inserted

After regulation 52 of the Principal Regulations , the following regulation is inserted in Part 11:

52A.   Inspection and publication of register

For the purposes of section 82(5) of the Act, each of the following is a prescribed person:
(a) the CEO of ARPANSA;
(b) a person engaged as an employee under the Public Service Act 1999 of the Commonwealth for the purposes of ARPANSA.

7.    Regulation 62 substituted

Regulation 62 of the Principal Regulations is rescinded and the following regulation is substituted:

62.   Confidentiality

For the purposes of section 59(3)(g) of the Act –
(a) each of the following is a prescribed person:
(i) the CEO of ARPANSA;
(ii) a person engaged as an employee under the Public Service Act 1999 of the Commonwealth for the purposes of ARPANSA; and
(b) reporting information, to ARPANSA, for inclusion in the Australian Radiation Incident Register is a prescribed purpose.

8.    Schedule 1 amended (Fees)

Schedule 1 to the Principal Regulations is amended as follows:
(a) by omitting item 5 and substituting the following item:

(a) if 1 to 5 persons are specified in application for licence as likely to be dealing with radiation apparatus or sealed source

(b) if 6 to 10 persons are specified in application for licence as likely to be dealing with radiation apparatus or sealed source

(c) if more than 10 persons are specified in application for licence as likely to be dealing with radiation apparatus or sealed source

(b) by omitting item 8 and substituting the following item:

These regulations are administered in the Department of Health and Human Services.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Radiation Protection Regulations 2006 by –
(a) prescribing the persons to whom the Director of Public Health may publish, or make available for inspection, all or part of the register of authorities required to be kept under the Radiation Protection Act 2005 ; and
(b) revising certain licence fees; and
(c) making other minor consequential and miscellaneous amendments.
