Traffic (Road Rules) Amendment Regulations 2007

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Traffic Act 1925 .

1.   Short title

These regulations may be cited as the Traffic (Road Rules) Amendment Regulations 2007 .

2.   Commencement

These regulations take effect on 24 September 2007.

3.   Principal Rules

In these regulations, the Traffic (Road Rules) Regulations 1999 are referred to as the Principal Rules.

4.    Rule 25 amended (Speed-limit elsewhere)

Rule 25(3)(a) of the Principal Rules is amended by inserting "or as otherwise provided under another law of this jurisdiction" after "hour".

5.    Rule 378A inserted

After rule 378 of the Principal Rules , the following rule is inserted in Division 7 of Part 22:

378A.   Temporary default speed-limit for Kingborough municipality

(1)  Until midnight on the prescribed day, the default speed-limit under rule 25(3)(a) and (b) for any driver within the municipal area of Kingborough is –
(a) 90 kilometres per hour on a sealed length of road; and
(b) 80 kilometres per hour on an unsealed length of road.
(2)  In this rule –
prescribed day means such day as the Minister, by public notice, nominates;
public notice means a notice, in the Gazette, that is not a statutory rule within the meaning of the Rules Publication Act 1953 ;
sealed length of road means a length of road that is paved with bitumen, concrete or another smooth, bonded, weather-resistant material;
unsealed length of road includes a length of road with a compacted or loose gravel surface.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Road Rules by providing that, for a temporary period, the default speed limit for all drivers outside built-up areas in the Kingborough municipality is 90 kilometres per hour on sealed roads and 80 kilometres per hour on unsealed roads.
