Poisons Amendment Regulations 2007

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

1.   Short title

These regulations may be cited as the Poisons Amendment Regulations 2007 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Poisons Regulations 2002 are referred to as the Principal Regulations.

4.    Regulation 33 amended (Destruction of narcotic substances prohibited)

Regulation 33 of the Principal Regulations is amended as follows:
(a) by omitting from subregulation (2)(f) "substance." and substituting "substance; or";
(b) by inserting the following after paragraph (f) in subregulation (2) :
(g) by an enrolled nurse working jointly with a health professional to destroy the narcotic substance.
(c) by omitting from subregulation (4) "health professional" twice occurring and substituting "person".

5.    Part 4, Division 5: Heading amended

Division 5 of Part 4 of the Principal Regulations is amended by omitting "Administration of substances by enrolled nurses" from the heading to that Division and substituting "Administration of substances by nurses".

6.    Regulation 59 amended (Enrolled nurse may administer certain substances)

Regulation 59 of the Principal Regulations is amended by omitting " Schedule 2 , 3 or 4 " and substituting " Schedule 2 , 3 , 4 or 8 ".

7.    Regulation 63 amended (Prescribed persons for section 38(1)(i) of Act)

Regulation 63(c) of the Principal Regulations is amended as follows:
(a) by omitting from subparagraph (i) "Nursing Board" and substituting "Secretary";
(b) by omitting from subparagraph (ii) "that Board" and substituting "the Secretary".

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Poisons Regulations 2002 by –
(a) providing that an enrolled nurse may administer narcotic substances; and
(b) providing that an enrolled nurse, acting jointly with a registered nurse or other health professional, may destroy narcotic substances, and
(c) providing that certain matters governing the administration of vaccines by registered nurses are to be determined by the Secretary of the Department of Health and Human Services rather than the Nursing Board; and
(d) effecting minor statute law revision.
