Food Amendment Regulations 2007

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Food Act 2003 .

1.   Short title

These regulations may be cited as the Food Amendment Regulations 2007 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Food Regulations 2003 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3 of the Principal Regulations is amended as follows:
(a) by omitting " Food Act 2003 ." from the definition of Act and substituting " Food Act 2003 ;";
(b) by inserting the following definition after the definition of Act :
Seafood Standard means the Primary Production and Processing Standard for Seafood contained in chapter 4.2.1 of the Food Standards Code.

5.    Regulation 6A inserted

After regulation 6 of the Principal Regulations , the following regulation is inserted:

6A.   Primary food production

For the purposes of section 7(2) of the Act, the definition of "primary food production" in the Act does not include the following food production activities:
(a) primary production of seafood, as defined in clause 2 of the Seafood Standard;
(b) processing of seafood, as defined in clause 2 of the Seafood Standard.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Food Regulations 2003 by providing that the definition of "primary food production" in the Food Act 2003 does not include primary production of seafood, or processing of seafood, as defined in the Primary Production and Processing Standard for Seafood contained in the Australia New Zealand Food Standards Code.
