Nature Conservation (Open Seasons) Amendment Order 2007

I make the following order under section 30(1) of the Nature Conservation Act 2002 .

1.   Short title

This order may be cited as the Nature Conservation (Open Seasons) Amendment Order 2007 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Principal Order

In this order, the Nature Conservation (Open Seasons) Order 2004 is referred to as the Principal Order.

4.    Clause 4 substituted

Clause 4 of the Principal Order is revoked and the following clause is substituted:

4.   Open season for wild duck

(1)  In this clause –
King Island means the municipal area of King Island;
wild duck means any bird of a species of the family Anatidae that is a form of partly protected wildlife.
(2)  In King Island, the open season for wild duck is –
(a) for 2007, the period starting on 24 March and ending on 3 June of that year; and
(b) for any subsequent year, the period starting on the Saturday nearest 8 March of the year and ending on the Sunday immediately before the first Monday in June of the year.
(3)  In any place other than King Island, the open season for wild duck is –
(a) for 2007, the period starting on 24 March and ending on 11 June of that year; and
(b) for any subsequent year, the period starting on the Saturday nearest 8 March of the year and ending on the Sunday nearest 8 June of the year, except where that Sunday immediately precedes the second Monday in June, in which case the period ends on the second Monday in June.

EXPLANATORY NOTE

(This note is not part of the order)

This order amends the Nature Conservation (Open Seasons) Order 2004 by –
(a) varying the 2007 open season for wild duck; and
(b) making minor consequential amendments.
