Administrative Arrangements Amendment Order (No. 3) 2006

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following order under section 4(1) of the Administrative Arrangements Act 1990 .

1.   Short title

This order may be cited as the Administrative Arrangements Amendment Order (No. 3) 2006 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Interpretation

The Acts Interpretation Act 1931 applies to the interpretation of this order as if this order were by-laws.

4.   Principal Order

In this order, the Administrative Arrangements Order 2006 is referred to as the Principal Order.

5.    Schedule 1 amended (Administration of Departments and Enactments)

Schedule 1 to the Principal Order is amended as follows:
(a) by omitting from Part 3 – Minister for Education the following item:

Tasmanian Early Years Foundation Act 2005

(b) by omitting from Part 4 – Minister for Energy

Electricity Supply Industry Act 1995

Part 6 (otherwise see Department of Treasury and Finance under the Treasurer)

and substituting the following item:

Electricity Supply Industry Act 1995

except Part 2 , Divisions 3 , 4 , 5 , 6 , 8A and 10 of Part 3 and except in so far as it relates to vesting agreements (see Department of Treasury and Finance under the Treasurer)

(c) by inserting in Part 4  – Minister for Energy after the item relating to the Gas Pipelines Act 2000 the following item:

Petroleum Products Emergency Act 1994

(d) by inserting in Part 7  – Minister for Local Government and Community Development after the item relating to the Southern Regional Cemetery Act 1981 the following item:

Tasmanian Early Years Foundation Act 2005

(e) by omitting from Part 9 – Minister for Police and Emergency Management the following item:

Petroleum Products Emergency Act 1994

(f) by omitting from Part 11 – Minister for Primary Industries and Water the following item:

Water Efficiency Labelling and Standards Act 2005

(g) by inserting in Part 14  – Minister for Tourism, Arts and the Environment after the item relating to the Tourism Tasmania Act 1996 the following item:

Water Efficiency Labelling and Standards Act 2005

(h) by omitting from Part 15 – Treasurer

Electricity Supply Industry Act 1995

except Part 6 (see Department of Infrastructure, Energy and Resources under the Minister for Energy)

and substituting the following item:

Electricity Supply Industry Act 1995

Part 2 , Divisions 3 , 4 , 5 , 6 , 8A and 10 of Part 3 and in so far as it relates to vesting agreements (otherwise see Department of Infrastructure, Energy and Resources under the Minister for Energy)

Displayed and numbered in accordance with the Rules Publication Act 1953.

This order is administered in the Department of Premier and Cabinet.

EXPLANATORY NOTE

(This note is not part of the order)

This order amends the Administrative Arrangements Order 2006  –
(a) by transferring the administration of the Tasmanian Early Years Foundation Act 2005 from the Minister for Education to the Minister for Local Government and Community Development; and
(b) by transferring the administration of certain parts of the Electricity Supply Industry Act 1995 from the Treasurer to the Minister for Energy; and
(c) by transferring the administration of the Petroleum Products Emergency Act 1994 from the Minister for Police and Emergency Management to the Minister for Energy; and
(d) by transferring the administration of the Water Efficiency Labelling and Standards Act 2005 from the Minister for Primary Industries and Water to the Minister for Tourism, Arts and the Environment.
