Chiropractors and Osteopaths Registration Amendment Regulations 2006

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Chiropractors and Osteopaths Registration Act 1997 .

1.   Short title

These regulations may be cited as the Chiropractors and Osteopaths Registration Amendment Regulations 2006 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Chiropractors and Osteopaths Registration Regulations 2003 are referred to as the Principal Regulations.

4.    Regulation 5 amended (Prescribed person for section 56(2)(c) of Act)

Regulation 5 of the Principal Regulations is amended as follows:
(a) by inserting the following definition before the definition of manipulation in subregulation (1) :
approved course of study or training means a course of study or training the successful completion of which results in a qualification that is approved by, or obtained from an institution that is accredited by –
(a) the Council on Chiropractic Education Australasia Incorporated (ABN 19 206 915 328); or
(b) the Australasian Conference of Osteopaths Registration Boards;
(b) by omitting subregulation (2) and substituting the following subregulation:
(2)  For the purposes of section 56(2)(c) of the Act –
(a) a person who is registered, licensed or otherwise specifically authorised to practise chiropractic or osteopathy in another jurisdiction is a prescribed person in circumstances where –
(i) the person is registered as a participant, instructor or presenter at an endorsed conference; and
(ii) the person is participating in, or is an instructor or presenter at, the endorsed conference; and
(iii) the person is performing manipulation on another person or using or applying a prescribed procedure during, and as part of, the endorsed conference; and
(iv) the manipulation or prescribed procedure is being performed on a volunteer, or another participant, instructor or presenter, at the endorsed conference; and
(b) a person who is enrolled in the final year of an approved course of study or training is a prescribed person in circumstances where the person is –
(i) approved by the Board as a person who may perform manipulation on another person or use or apply a prescribed procedure under the supervision, and in accordance with the instructions, of a registered practitioner; and
(ii) performing manipulation on another person or using or applying a prescribed procedure under such supervision, and in accordance with such instructions, as part of the clinical placement requirements of the approved course of study or training.

5.    Regulation 6 amended (Prescribed national body and forum)

Regulation 6 of the Principal Regulations is amended as follows:
(a) by omitting from subregulation (1) "Council on Chiropractic Education Australasia Inc" and substituting "Council on Chiropractic Education Australasia Incorporated (ABN 19 206 915 328)";
(b) by omitting from subregulation (2) "Australian Conference of Osteopath Registration Boards" and substituting "Australasian Conference of Osteopaths Registration Boards".

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Chiropractors and Osteopaths Registration Regulations 2003 by –
(a) providing that a person enrolled in a certain course of study or training is, in certain circumstances, a prescribed person for the purposes of section 56(2)(c) of the Chiropractors and Osteopaths Registration Act 1997 ; and
(b) correcting references to the Council on Chiropractic Education Australasia Incorporated and the Australasian Conference of Osteopaths Registration Boards.
