Genetically Modified Organisms Control (GMO-free Area) Order 2005

I make the following order under section 5(1) of the Genetically Modified Organisms Control Act 2004 .

1.   Short title

This order may be cited as the Genetically Modified Organisms Control (GMO-free Area) Order 2005 .

2.   Commencement

This order takes effect on 15 November 2005.

3.   Interpretation

The Acts Interpretation Act 1931 applies to the interpretation of this order as if it were regulations within the meaning of that Act.

4.   GMO-free area

The whole of Tasmania is declared to be a GMO-free area.

Displayed and numbered in accordance with the Rules Publication Act 1953.

This order is administered in the Department of Primary Industries, Water and Environment.

EXPLANATORY NOTE

(This note is not part of the order)

This order declares the whole of Tasmania to be a GMO-free area. The effect of this declaration is that a person may only deal with a genetically modified organism in Tasmania if authorised to do so by both a permit under the Genetically Modified Organisms Control Act 2004 and a GMO licence under either the Gene Technology Act 2000 of the Commonwealth or the Tasmanian Gene Technology Act 2001 .
