Marine and Safety (Safe Operation) Amendment Regulations 2005

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Marine and Safety Authority Act 1997 .

1.   Short title

These regulations may be cited as the Marine and Safety (Safe Operation) Amendment Regulations 2005 .

2.   Commencement

These regulations take effect on the seventh day after the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Marine and Safety (Safe Operation) Regulations 2003 are referred to as the Principal Regulations.

4.    Schedule 1 amended (Prescribed fees)

Schedule 1 to the Principal Regulations is amended as follows:
(a) by inserting the following item after item 1 in Part 1 :
2.   The fees specified in items 1 to 6 of Part 2 of this Schedule and item 1 of Part 3 of this Schedule are GST inclusive.
(b) by omitting Part 2 and substituting the following Part:

83.33 for each hour taken to consider the application

Revocation of suspension of SMP

1.   Travelling fees for a person to attend a vessel to conduct an inspection under regulation 38(6) or a safety audit follow-up under regulation 51 are to be charged in accordance with the following table:
