Police Offences (Liquor) Regulations 2005

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Police Offences Act 1935 .

1.   Short title

These regulations may be cited as the Police Offences (Liquor) Regulations 2005 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Penalty under liquor infringement notice

For the purposes of section 61(2) of the Police Offences Act 1935 , the prescribed penalty is 1 penalty unit.

4.   Form of withdrawal notice

For the purposes of section 62(2) of the Police Offences Act 1935 , a notice withdrawing a liquor infringement notice is to be in accordance with the formin Schedule 1 .

5.   Legislation rescinded

The legislation specified in Schedule 2 is rescinded.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations –
(a) prescribe the penalty payable in respect of a liquor infringement notice; and
(b) prescribe the form of notice for withdrawing a liquor infringement notice; and
(c) rescind the Police Offences (Liquor) Regulations 1996 .
