River Clyde Irrigation Rights Order 2005

I make the following order under section 75 of the Irrigation Clauses Act 1973 .

1.   Short title

This order may be cited as the River Clyde Irrigation Rights Order 2005 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Interpretation

In this order –

property identification number means a number that identifies land contained in the Land Information System Tasmania administered by the Department.

4.   Irrigation rights

(1)  An irrigation right is conferred on an owner or occupier specified in column 4 of Schedule 1 to this order in relation to the land identified by the property identification number specified adjacent to that owner or occupier in column 3 of that Schedule.

(2)  The irrigation right of an owner or occupier of land conferred under subclause (1) is the right to be supplied with the amount of water specified in column 5 of Schedule 1 to this order –

(a) adjacent to the property identification number of that land specified in column 3 of that Schedule; and

(b) from the source specified adjacent to that amount of water in column 6 of that Schedule.

SCHEDULE 1 - River Clyde Irrigation Rights

This order is administered in the Department of Primary Industries, Water and Environment.

This order confers irrigation rights on certain owners and occupiers of land within the River Clyde Irrigation District.
