Racing Regulation Amendment (Restructure) Regulations 2004

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Racing Regulation Act 1952 .

1.   Short title

These regulations may be cited as the Racing Regulation Amendment (Restructure) Regulations 2004 .

2.   Commencement

These regulations take effect on the day on which the Racing Regulation Act 2004 commences.

3.   Principal Regulations

In these regulations, the Racing Regulation Regulations 1976 are referred to as the Principal Regulations.

4.   Regulation 1 amended (Short title)

Regulation 1 of the Principal Regulations is amended by omitting "Regulation" and substituting "(Totalizator Betting)".

5.   Regulation 3 substituted

Regulation 3 of the Principal Regulations is rescinded and the following regulation is substituted:

3.   Interpretation

In these regulations –
Act means the Racing (Totalizator Betting) Act 1952.

6.   Part III rescinded

Part III of the Principal Regulations is rescinded.

7.   Regulation 53 amended (Form of authority of supervisor)

Regulation 53 of the Principal Regulations is amended by inserting "in Schedule II" after "form 12".

8.   Parts V and VI rescinded

Parts V and VI of the Principal Regulations are rescinded.

9.   Regulation 197 rescinded

Regulation 197 of the Principal Regulations is rescinded.

10.   Schedule II amended (Forms)

Schedule II to the Principal Regulations is amended by omitting Forms 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 13, 14 and 15.

11.   Schedule III rescinded

Schedule III to the Principal Regulations is rescinded.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Racing Regulation Regulations 1976 consequent on the enactment of the Racing Regulation Act 2004 .  Specifically, the regulations –
(a) omit extensive racing, bookmaking and betting provisions that have been superseded by provisions of that new Act or regulations under that new Act; and
(b) rename the residue of the regulations as the Racing (Totalizator Betting) Regulations 1976 to reflect the fact that, essentially, they only concern totalizator betting.
