Land Use Planning and Approvals (Application of Act) Regulations 2004

I, the Administrator in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Land Use Planning and Approvals Act 1993 .

1.   Short title

These regulations may be cited as the Land Use Planning and Approvals (Application of Act) Regulations 2004 .

2.   Commencement

These regulations take effect on 1 January 2005.

3.   Interpretation

(1)  In these regulations –
telecommunications infrastructure means –
(a) any underground conduit or cable; and
(b) any inspection pits or similar facilities installed in conjunction with the conduit or cable; and
(c) any equipment installed in conjunction with the conduit or cable; and
(b) any cable or conduit location marking post or sign installed in conjunction with the conduit or cable.
(2)  In these regulations, a reference to a "pipeline", "supply pipeline" or "transmission pipeline" is a reference to a pipeline, supply pipeline or transmission pipeline within the meaning of the Gas Pipelines Act 2000 .

4.   Excluded development

The following kinds of development are prescribed as classes of development for the purposes of the definition of "development" in section 3(1) of the Land Use Planning and Approvals Act 1993 :
(a) the installation of telecommunications infrastructure in conjunction with the construction of a pipeline constructed in accordance with a permit;
(b) the construction of a supply pipeline in conjunction with the construction of a transmission pipeline constructed in accordance with a permit where no part of that construction is more than 10 metres from the transmission pipeline.

These regulations exclude certain activities from the definition of development in the Land Use Planning and Approvals Act 1993 ; they replace the Land Use Planning and Approvals (Application of Act) Regulations 1994 .
