Cressy-Longford Irrigation Water District Amendment By-laws 2004

The Cressy-Longford Irrigation Scheme Limited, with the approval of the Minister and consent of the Administrator, makes the following by-laws under the Irrigation Clauses Act 1973 .

1.   Short title

These by-laws may be cited as the Cressy-Longford Irrigation Water District Amendment By-laws 2004 .

2.   Commencement

These by-laws take effect on the day on which their making is notified in the Gazette.

3.   Principal By-laws

In these by-laws, the Cressy-Longford Irrigation Water District By-laws 2000 are referred to as the Principal By-laws.

4.    Clause 3 substituted

Clause 3 of the Principal By-laws is rescinded and the following clause is substituted:

3.   Interpretation

In these by-laws –

Water District means the Cressy-Longford Irrigation Water District specified in the Schedule to Statutory Rules 1978, No. 30.

5.    Clause 4 amended (Commission to supply water for irrigation)

Clause 4 of the Principal By-laws is amended as follows:

(a) by omitting the headnote and substituting the following headnote:

Supply of water for irrigation

(b) by omitting from subclause (1) "Commission is" and substituting "undertakers are";

(c) by omitting from subclause (2) "Commission" and substituting "undertakers".

6.    Clause 5 amended (Notice of irrigation season)

Clause 5(1) of the Principal By-laws is amended as follows:

(a) by omitting "Commission" and substituting "undertakers";

(b) by omitting "in the Gazette and";

(c) by omitting "is" and substituting "are".

7.    Clause 6 amended (Reading of meter)

Clause 6 of the Principal By-laws is amended as follows:

(a) by omitting "Commission is" and substituting "undertakers are";

(b) by omitting from paragraph (b) "Commission considers" and substituting "undertakers consider".

8.    Clause 7 amended (Accounts)

Clause 7 of the Principal By-laws is amended as follows:

(a) by omitting "Commission" first occurring and substituting "undertakers";

(b) by omitting "Commission determines" and substituting "undertakers determine".

9.    Clause 8 amended (Rates and charges)

Clause 8 of the Principal By-laws is amended by omitting subclause (2) and substituting the following subclause:

(2)  Rates and charges are to be paid to the undertakers at a place for payment specified in the account.

10.    Clause 9 amended (Request for testing meter)

Clause 9 of the Principal By-laws is amended as follows:

(a) by omitting from subclause (1) "Commission" and substituting "undertakers";

(b) by omitting from subclause (2) "Commission" and substituting "undertakers".

11.    Clause 10 amended (Testing of meter)

Clause 10(1) of the Principal By-laws is amended as follows:

(a) by omitting from paragraph (a) "Commission" and substituting "undertakers";

(b) by omitting from paragraph (b) "Commission" and substituting "undertakers".

12.    Clause 12 amended (Construction of works)

Clause 12 of the Principal By-laws is amended as follows:

(a) by omitting from subclause (1) "Commission" and substituting "undertakers";

(b) by omitting from subclause (2) "Commission" and substituting "undertakers";

(c) by omitting from subclause (3) "Commission" and substituting "undertakers".

13.    Clause 13 amended (Register of land)

Clause 13 of the Principal By-laws is amended as follows:

(a) by omitting from subclause (1) "Commission is" and substituting "undertakers are";

(b) by omitting from subclause (3) "Commission" and substituting "undertakers".

These by-laws were made by the undertakers, the Cressy-Longford Irrigation Scheme Limited, at a meeting held on 11 November 2004.

EXPLANATORY NOTE

(This note is not part of the bylaw)

(a) changing references to the "Commission" to "the undertakers"; and

(b) altering the requirements for the notification of an irrigation season; and

(c) making further provision in relation to the place at which rates and charges may be paid.
