State Policies and Projects Regulations 2004

I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the State Policies and Projects Act 1993 .

1.   Short title

These regulations may be cited as the State Policies and Projects Regulations 2004 .

2.   Commencement

These regulations take effect on 1 January 2005.

3.   Interpretation

In these regulations –
Act means the State Policies and Projects Act 1993 .

4.   Commission to advertise exhibition of draft State Policy

For the purpose of section 6(2)(b) of the Act, the Commission is to –
(a) advertise the exhibition of the draft State Policy in at least 2 daily newspapers circulating generally in the State; and 
(b) include a statement in that advertisement advising –
(i) that the draft State Policy is to be displayed at the office of the Commission; and
(ii) of the right of any person to submit representations in accordance with section 8 of the Act.

5.   Notice of amendment of planning scheme or interim order

For the purposes of section 13(5)(b) of the Act, notice of an amendment by the Commission of a planning scheme or an interim order is to –
(a) describe the effect of the State Policy; and
(b) state details of the amendments made to the planning scheme or interim order as a result of their inconsistency with the State Policy; and
(c) be printed in a daily newspaper circulating generally in the area to which the planning scheme or interim order relates; and
(d) be displayed at the office of –
(i) the Commission; and
(ii) the planning authority which administers the planning scheme or interim order.

6.   Commission to advertise exhibition of draft integrated assessment report

For the purpose of section 22(b) of the Act, the Commission is to advertise the exhibition of the draft integrated assessment report in at least 2 daily newspapers circulating generally in the State and that advertisement is to –
(a) include a description of the project of State significance; and
(b) specify the place at which the draft integrated assessment report may be inspected; and
(c) contain a statement advising of the right of any person to submit representations in accordance with section 23 of the Act.

7.   Notice of State of the Environment Report available for public inspection and purchase

For the purpose of section 29(2)(b) of the Act, the Commission is to cause notice to be given in the Gazette that the State of the Environment Report is available for public inspection and purchase at the office of the Commission.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations replace the State Policies and Projects Regulations 1993; they make provision in respect of –
(a) the prescribed requirements for the advertising of draft State Policies and draft integrated assessment reports; and
(b) the prescribed requirements for the making of, and the content of, certain notices.
