Local Government Amendment Regulations 2004

I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Local Government Act 1993 .

1.   Short title

These regulations may be cited as the Local Government Amendment Regulations 2004 .

2.   Commencement

These regulations take effect on 1 November 2004.

3.   Principal Regulations

In these regulations, the Local Government Regulations 1994 are referred to as the Principal Regulations.

4.    Regulation 29 substituted

Regulation 29 of the Principal Regulations is rescinded and the following regulation is substituted:

29.   Allowances for elected members

(1)  In this regulation –
Consumer Price Index figure has the same meaning as in Part 9 of the Act;
inflationary factor, in respect of each year, means the amount ascertained by dividing the Consumer Price Index figure for the June quarter of that year by the Consumer Price Index figure for the June quarter of the previous year;
June quarter, in relation to a year, means April, May and June of that year;
year means the period of 12 months starting on 1 November and ending on 31 October.
(2)  The allowances for the year starting on 1 November 2004 payable to mayors, deputy mayors and councillors are as follows:

(3)  The allowances payable to mayors, deputy mayors and councillors in each subsequent year –
(a) take effect on 1 November of that year; and
(b) are calculated by multiplying the allowances for the previous year by the inflationary factor for the current year.

(This note is not part of the regulation)

These regulations amend the Local Government Regulations 1994 by  –
(a) prescribing the allowances payable to mayors, deputy mayors and councillors for the year starting on 1 November 2004; and
(b) setting out the procedure for calculating those allowances in subsequent years.
