Environmental Management and Pollution Control (Infringement Notices) Amendment Regulations 2004

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Environmental Management and Pollution Control Act 1994 .

1.   Short title

These regulations may be cited as the Environmental Management and Pollution Control (Infringement Notices) Amendment Regulations 2004 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Environmental Management and Pollution Control (Infringement Notices) Regulations 1996 are referred to as the Principal Regulations.

4.    Schedule 2 amended (Prescribed offences)

Part 2 of Schedule 2 to the Principal Regulations is amended as follows:
(a) by omitting item 1 ;
(b) by omitting item 3 and substituting the following item:
3.   Environmental Management and Pollution Control (Miscellaneous Noise) Regulations 2004

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Environmental Management and Pollution Control (Infringement Notices) Regulations 1996 to –
(a) reflect the rescission of the –
(i) Environment Protection (Atmospheric Pollution) Regulations 1974; and
(ii) Environment Protection (Noise) Regulations 1977; and
(iii) Environment Protection (Prohibited Fuels) Regulations 1991; and
(b) prescribe certain offences under the Environmental Management and Pollution Control (Miscellaneous Noise) Regulations 2004 in respect of which infringement notices may be issued.
