Inland Fisheries (Seasons and Waters) Amendment Order 2004
I make the following order under section 197 of the Inland Fisheries Act 1995 .

This order may be cited as the Inland Fisheries (Seasons and Waters) Amendment Order 2004 .
This order takes effect on the day on which its making is notified in the Gazette.
In this order, the Inland Fisheries (Seasons and Waters) Order 1996 is referred to as the Principal Order.
4. Clause 3 amended (Interpretation)
Clause 3(1) of the Principal Order is amended by inserting after the definition of Act the following definition:Canal Bay has the same meaning as in the Inland Fisheries (Recreational Fishing) Regulations 1999 ;
5. Clause 4 amended (Taking of acclimatised fish)
Clause 4 of the Principal Order is amended as follows:(a) by omitting from subclause (1)(a) "Saturday nearest 1 August" and substituting "first Saturday of August";(b) by omitting subparagraph (i) from subclause (1)(c) ;(c) by inserting in subclause (1)(c)(ii) "and" after "Lake;";(d) by omitting from subclause (1)(f)(vii) "Pedder." and substituting "Pedder;";(e) by inserting the following paragraph after paragraph (f) in subclause (1) :(g) between the Saturday nearest 1 December in any year and the Sunday nearest 31 March in the next year, in Canal Bay in Great Lake.(f) by omitting from subclause (2) "Saturday nearest 1 August" and substituting "first Saturday of August".
6. Clause 5 amended (Taking indigenous fish)
Clause 5(a) of the Principal Order is amended by omitting "Saturday nearest 1 August" and substituting "first Saturday of August".
7. Clause 8 amended (Prohibition on taking fish)
Clause 8 of the Principal Order is amended as follows:(a) by inserting the following paragraph after paragraph (b) :(ba) waters in that part of Curries River Reservoir within 400 metres of the dam tower;(b) by omitting from paragraph (q) "Commission" twice occurring and substituting "Director";(c) by omitting from paragraph (r) "Commission" and substituting "Director".

EXPLANATORY NOTE
(This note is not part of the order)
This order amends the Inland Fisheries (Seasons and Waters) Order 1996 by –(a) prohibiting the taking of fish from Curries River Reservoir within 400 metres of the dam tower; and(b) providing that, at certain places, licensed persons may commence taking acclimatised fish and blackfish on the first Saturday of August; and(c) providing that acclimatised fish may be taken from Canal Bay in Great Lake between the Saturday nearest 1 December in any year and the Sunday nearest 31 March in the next year; and(d) making other minor amendments.
