Poisons Amendment Regulations 2003

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

1.   Short title

These regulations may be cited as the Poisons Amendment Regulations 2003 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Poisons Regulations 2002 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3(1) of the Principal Regulations is amended by omitting the definition of narcotic substance .

5.    Regulation 51 amended (Supply of potent substances by pharmaceutical chemists)

Regulation 51 of the Principal Regulations is amended as follows:
(a) by omitting from subregulation (2) " Schedule 2 " and substituting " Schedule 3 ";
(b) by omitting from subregulation (4) " Schedule 2 " and substituting " Schedule 3 ".

6.    Schedule 6 amended (Specified potent substances)

Schedule 6 to the Principal Regulations is amended by omitting item 4 .

7.    Schedule 7 amended (Class 1 substances)

Schedule 7 to the Principal Regulations is amended by inserting after item 9 the following item:
9A.   Olopatadine.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Poisons Regulations 2002 by –
(a) omitting the definition of "narcotic substance"; and
(b) correcting certain references; and
(c) omitting insulin from Schedule 6; and
(d) adding olopatadine to the list of substances in Schedule 7.
