I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Traffic Act 1925 .

1.   Short title

These regulations may be cited as the Traffic (Compliance and Enforcement) Amendment Regulations (No. 2) 2003 .

2.   Commencement

These regulations take effect on 1 October 2003.

3.   Principal Regulations

In these regulations, the Traffic (Compliance and Enforcement) Regulations 2001 are referred to as the Principal Regulations.

4.   Schedule 2 amended (Traffic infringement notice offences)

Schedule 2 to the Principal Regulations is amended by omitting item 212 from Part 2 and substituting:

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Traffic (Compliance and Enforcement) Regulations 2001 by –
(a) increasing the fine payable for the traffic infringement notice offence of driving while using a hand-held mobile phone; and
(b) introducing a demerit point penalty for that offence.
