Poisons Amendment (Vaccination Administration) Regulations 2003
I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

These regulations may be cited as the Poisons Amendment (Vaccination Administration) Regulations 2003 .
These regulations take effect on the day on which their making is notified in the Gazette.
In these regulations, the Poisons Regulations 2002 are referred to as the Principal Regulations.
4. Regulation 3 amended (Interpretation)
Regulation 3(1) of the Principal Regulations is amended as follows:(a) by inserting the following definition after the definition of Director of Ambulance Services :Director of Public Health means the Director of Public Health appointed under the Public Health Act 1997 ;(b) by inserting the following definition after the definition of narcotic substance :Nursing Board means the Nursing Board of Tasmania established under the Nursing Act 1995 ;
5. Regulation 63 amended (Prescribed persons for purposes of section 38(1)(i) of Act)
Regulation 63 of the Principal Regulations is amended as follows:(a) by omitting from paragraph (b) "Poisons List." and substituting "Poisons List; and";(b) by inserting the following paragraph after paragraph (b) :(c) a person who is a registered nurse and who may administer to another person a vaccine listed in Schedule 4 to the Poisons List in accordance with a vaccination program approved by the Director of Public Health.(i) has completed an educational program approved by the Nursing Board relating to the administration of vaccines; and(ii) has been approved by that Board to administer vaccines independently
6. Regulation 69 amended (Prescription, &c., of certain substances prohibited, unless authorised by Secretary)
Regulation 69(1) of the Principal Regulations is amended by inserting after paragraph (a) the following paragraph:(ab) bexarotene for human use;
7. Regulation 70 amended (Precautions in prescribing substances capable of producing birth defects)
Regulation 70 of the Principal Regulations is amended as follows:(a) by inserting in subregulation (1) "bexarotene," after "acitretin,";(b) by inserting in subregulation (2)(a) "bexarotene," after "acitretin,";(c) by inserting in subregulation (2)(b)(ii) ", bexarotene" after "tretinoin for oral use".
8. Regulation 79 amended (Wholesale dealing)
Regulation 79(3) of the Principal Regulations is amended by omitting paragraph (j) and substituting the following paragraph:(j) in respect of the substances specified in regulation 63 , a registered nurse referred to in paragraph (c) of that regulation or a dental therapist.
9. Schedule 4 amended (Specified psychotropic substances)
Schedule 4 to the Principal Regulations is amended as follows:(a) by inserting the following item after item 23 :23A. Darbepoetin alfa.(b) by inserting the following items after item 28 :28A. Epoetin alfa.28B. Epoetin beta.(c) by inserting the following item after item 29 :29A. Erythropoietins not elsewhere specified in this Schedule.

These regulations amend the Poisons Regulations 2002 by prescribing registered nurses, who have completed an educational program approved by the Nursing Board of Tasmania and who have been approved by the Board, as a class of persons who may administer vaccines under section 38(1)(i) of the Poisons Act 1971 .
