Mental Health Amendment Regulations 2003

I, the Administrator in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Mental Health Act 1996 .

1.   Short title

These regulations may be cited as the Mental Health Amendment Regulations 2003 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Mental Health Regulations 1999 are referred to as the Principal Regulations.

4.    Regulation 9 inserted

After regulation 8 of the Principal Regulations , the following regulation is inserted:

9.   Prescribed corresponding laws

For the purpose of the definition of "corresponding law" in section 83A of the Act, the following laws are prescribed as corresponding laws:
(a) Mental Health Act 1986 [VIC];
(b) Mental Health Act 1990 [NSW];
(c) Mental Health (Treatment and Care) Act 1994 [ACT];
(d) Mental Health and Related Services Act 1998 [NT];
(e) Mental Health Act 2000 [QLD].

These regulations amend the Mental Health Regulations 1999 by prescribing certain interstate laws to be corresponding laws for the purpose of section 83A of the Mental Health Act 1996 .
