Marine Farming Planning Amendment (Infringement Notices) Regulations 2003

I, the Administrator in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under section 145 of the Marine Farming Planning Act 1995 .

1.   Short title

These regulations may be cited as the Marine Farming Planning Amendment (Infringement Notices) Regulations 2003 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Marine Farming Planning Regulations 1996 are referred to as the Principal Regulations.

4.    Schedule 2 amended (Infringement notice offences)

Schedule 2 to the Principal Regulations is amended as follows:
(a) by omitting

and substituting the following item:

(b) by inserting after item 3 the following:

Contravening or failing to comply with condition or restriction of a lease - section 64(4)

(c) by inserting after item 8 the following:

Contravening or failing to comply with management control contained in a marine farming development plan, emergency order or emergency plan – section 91(1)(a)

(d) by inserting after item 16 the following:

Having rope, cable or other device securing marine farming equipment outside marine farming zone unless authorised – section 94(1)(a)

Having any marine farming equipment other than any rope, cable or other device securing any marine equipment, outside the lease area unless authorised – section 94(1)(b)

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Marine Farming Planning Regulations 1996 by providing for infringement notices to be issued for non-compliance with marine farming lease conditions and marine farming development plan management controls.
