Chiropractors and Osteopaths Registration Regulations 2003

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Chiropractors and Osteopaths Registration Act 1997 .

1.   Short title

These regulations may be cited as the Chiropractors and Osteopaths Registration Regulations 2003 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Interpretation

In these regulations –

Act means the Chiropractors and Osteopaths Registration Act 1997 ;

endorsed conference means a conference or training course that has been endorsed by the Board under regulation 4 .

4.   Endorsed conference

(1)  In this regulation,

conference or training course includes a proposed conference or training course.

(2)  The Board may endorse a conference or training course where –

(a) the conference or training course is for the education or training of chiropractors or osteopaths; and

(b) the conference or training course is to be held in Tasmania; and

(c) the Board is satisfied that the conference or training course is of a suitable standard of education or training; and

(d) the organisers of the conference or training course will comply with any requirements the Board may impose.

5.   Prescribed person for section 56(1)(c) of Act

(1)  In this regulation –

manipulation means the manipulation of the joints of the spinal column or its immediate articulations;

prescribed procedure means a procedure prescribed for the purposes of section 56 of the Act.

(2)  For the purposes of section 56(2)(c) of the Act, a person who is registered, licensed or otherwise specifically authorised to practise chiropractic or osteopathy in another jurisdiction is a prescribed person in circumstances where –

(a) the person is registered as a participant, instructor or presenter at an endorsed conference; and

(b) the person is participating in, or is an instructor or presenter at, the endorsed conference; and

(c) the person is performing manipulation on another person or using or applying a prescribed procedure during, and as part of, the endorsed conference; and

(d) the manipulation or prescribed procedure is being performed on a volunteer, or another participant, instructor or presenter, at the endorsed conference.

These regulationsprescribe for matters under the Chiropractors and Osteopaths Registration Act 1997 and specifically prescribe that a person in certain circumstances is exempt from section 56 of that Act.
