Allport Library and Museum of Fine Arts Regulations 2002
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Libraries Act 1984 .

These regulations may be cited as the Allport Library and Museum of Fine Arts Regulations 2002 .
These regulations take effect on 1 January 2003.
(1) In these regulations Act means the Libraries Act 1984 ;Agreement means the agreement approved by the Allport Library and Museum of Fine Arts Agreement Act 1966 ;Collection means the items forming the Allport Library and Museum of Fine Arts referred to in the Agreement;employee means (a) a person appointed or employed under section 5(3) of the Act; and(b) a person made available under an arrangement made under section 5(4) of the Act;item includes a book or any other article;reserved areas means (a) those areas of a building in which the Collection is kept under the Agreement; and(b) any parts of any such areas.(2) With regard to any permission required under these regulations, the Secretary may (a) grant or refuse any permission being sought; and(b) specify the terms and conditions of the permission being granted; and(c) make the terms and conditions (i) limited; or(ii) unlimited; and(d) cancel or amend the terms and conditions at any time by written notice to the holder of the permission.
4. Borrowing or removing items
(1) Despite these regulations, a person must not borrow, or be permitted to borrow, any item in the Collection except under the Agreement.Penalty: Fine not exceeding 0.5 penalty units.(2) A person must not remove any item in the Collection from the reserved areas except under the Agreement.Penalty: Fine not exceeding 0.5 penalty units.
(1) A person must not use, handle, copy, reproduce or remove an item of the Collection without the permission of the Secretary.Penalty: Fine not exceeding 0.5 penalty units.(2) The Secretary may grant permission for a person to use, handle, copy, reproduce or remove an item from the Collection if he or she considers the activity appropriate for research purposes.
6. Acknowledgment in publication
A person who intends to publish any work using any item in the Collection is to acknowledge the source of any information obtained from the Collection.
7. Photographs and electronic representations
(1) A person who does not have the permission of the Secretary is not to photograph or make an electronic representation of (a) any reserved areas; or(b) an item in the Collection; or(c) any part of an item in the Collection.(2) The Secretary may grant permission referred to in subregulation (1) if he or she considers the activity appropriate for research purposes.
(1) A person who has not attained the age of 12 years is not permitted in the reserved areas unless he or she is accompanied by a person who is 18 years or older or has the Secretary's permission to enter the reserved areas.(2) The Secretary may refuse admission to the reserved areas to a person without giving a reason for his or her refusal.(3) A person who has been refused admission to the reserved areas under subregulation (2) must not enter the reserved areas to which he or she has been refused admission.Penalty: Fine not exceeding 0.5 penalty units.(4) The Secretary may at any time close the reserved areas to the public.(5) A person must not enter or remain in the reserved areas while they are closed without the permission of the Secretary.Penalty: Fine not exceeding 0.5 penalty units.
An employee may direct a person to leave the reserved areas or exclude a person from the reserved areas if that person(a) contravenes any of the provisions of the Libraries Regulations 2002 whilst in the reserved areas; or(b) contravenes these regulations; or(c) enters the reserved areas without permission.
A person must not, without lawful excuse, set off any security alarm installed in the reserved areas.Penalty: Fine not exceeding 0.5 penalty units.

These regulations provide for (a) the use of the Allport Library and Museum of Fine Arts; and(b) the examination of items in the Allport Library and Museum of Fine Arts; and(c) the reproduction of items in the Allport Library and Museum of Fine Arts and acknowledgment of the Allport Library and Museum of Fine Arts in any publication using the reproductions.
