Poisons Amendment Regulations (No. 2) 2002
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

These regulations may be cited as the Poisons Amendment Regulations (No. 2) 2002 .
These regulations take effect on the day on which their making is notified in the Gazette.
In these regulations, the Poison Regulations 1975 are referred to as the Principal Regulations.
4. Regulation 2 amended (Interpretation)
Regulation 2(1) of the Principal Regulations is amended by omitting the definition of "dental therapist" and substituting the following:dental therapist means a person registered as a dental therapist under the Dental Practitioners Registration Act 2001 ;
Regulation 38A of the Principal Regulations is rescinded and the following regulation is substituted:38A. Prescribed persons for section 38(1)(i) of Act
For section 38(1)(i) of the Act (a) a person who is a dental therapist may, in the course of dental therapy, administer the following restricted substances to another person in the following specified circumstances:(i) demeclocycline (demethylchlortetracycline), when used in dental preparations;(ii) local anaesthetics, for use in dental treatment;(iii) topical fluorides, when used in dental preparations;(iv) triamcinolone acetonide, when used in dental preparations; and(b) a person who is a registered nurse may, in the course of nursing practice, administer a substance in Schedule 2 or 3 of the Poisons List to another person.
6. Regulation 43 amended (Wholesale dealing)
Regulation 43(3) of the Principal Regulations is amended as follows:(a) by omitting from paragraph (i) "1994." and substituting "1994; and";(b) by inserting after paragraph (i) the following paragraph:(j) a dental therapist in respect of the substances specified in regulation 38A(a).

EXPLANATORY NOTE
(This note is not part of the regulation)
These regulations amend the Poisons Regulations 1975 by (a) updating the definition of dental therapist; and(b) removing the requirement for dental therapists to be supervised when administering certain restricted substances; and(c) permitting wholesale and manufacturing chemists to supply dental therapists with those restricted substances; and(d) permitting registered nurses to administer medicinal poisons and potent substances in the course of nursing practice.
