Sale of Hazardous Goods Amendment Order 2002

The Products Safety Committee makes the following order under section 8 of the Sale of Hazardous Goods Act 1977 .

PART 1 - Preliminary

1.   Short title

This order may be cited as the Sale of Hazardous Goods Amendment Order 2002 .

2.   Commencement

This order takes effect on 1 November 2002.
PART 2 - Children's cots

3.    Sale of Hazardous Goods Order 1998 amended

After clause 4 of the Sale of Hazardous Goods Order 1998 , the following clause is inserted:

4A.   Exception

(1)  For the purpose of this clause –
antique cot means a cot, over 100 years old, that is purchased for its antique value and not for use as a children's cot;
collectable cot means a cot that is purchased to form part of a collection and not for use as a children's cot;
supplier means a person who sells an antique cot or collectable cot to another person.
(2)  Despite clause 4 , a person may sell an antique cot or a collectable cot if the cot –
(a) is accompanied by a certificate from the supplier to the consumer stating that it is not safe to place a child in the cot; and
(b) has two clearly visible warning notices, one outside and one inside, attached to the cot.
(3)  Each warning notice attached to the cot must –
(a) be printed on a metal plate; and
(b) be permanently attached to the cot by gluing, and by nailing or screwing, the metal plate to the upper half of the side or end of the cot; and
(c) have lettering in sharp contrast with the background; and
(d) have upper case letters no less than 5 millimetres in height and lower case letters no less than 2.5 millimetres in height; and
(e) use the following wording with the upper case lettering and underlining as shown:

PART 3 - Candle wicks

4.    Sale of Hazardous Goods Order 2000 amended

Clause 3 of the Sale of Hazardous Goods Order 2000 is amended as follows:
(a) by omitting from paragraph (a) "lead" and substituting "more than 0.06% lead by weight";
(b) by omitting from paragraph (b) "lead" and substituting "more than 0.06% lead by weight".

This order was made by the Products Safety Committee at a meeting held on 5 April 2002.
