Poisons List Amendment Order (No. 3) 2002

I make the following order under section 15(1) of the Poisons Act 1971 .

1.   Short title

This order may be cited as the Poisons List Amendment Order (No. 3) 2002 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette or on 1 September 2002, whichever is later.

3.   Principal Order

In this order, the Poisons List Order 2001 is referred to as the Principal Order.

4.    Schedule 2 amended (Medicinal Poisons)

Schedule 2 to the Principal Order is amended as follows:

(a) by omitting item 2027 and substituting the following:

2027.

Ciclopirox in preparations for dermal use containing less than 2% of ciclopirox.

(b) by omitting item 2098 and substituting the following:

2098.	Nicotine for use as an aid in withdrawal from tobacco smoking, in –
	(a) chewing gum; or
	(b) preparations for –
	(i) inhalation; or
	(ii) transdermal use.

5.    Schedule 3 amended (Potent Substances)

Schedule 3 to the Principal Order is amended as follows:

(a) by inserting after item 3014 the following:

3014M.

Clobetasone (clobetasone-17-butyrate) in preparations for dermal use containing 0.05% or less of clobetasone, in packs containing 30g or less of such preparations.

(b) by omitting item 3055 and substituting the following:

3055.	Nicotine for use as an aid in withdrawal from tobacco smoking –
	(a) in lozenges; or
	(b) in preparations for sublingual use.

(c) by inserting after item 3073 the following:

3073E.

Sodium picosulfate in preparations for oral use for bowel cleansing prior to diagnostic medical or surgical procedures.

6.    Schedule 4 amended (Restricted Substances)

Schedule 4 to the Principal Order is amended as follows:

(a) by omitting item 40366 and substituting the following:

(b) by inserting after item 40577 the following:

7.    Schedule 5 amended (Domestic Poisons)

Schedule 5 to the Principal Order is amended as follows:

(a) by inserting after paragraph (e) in item 5031 the following:

Bifluorides (including ammonium, potassium and sodium salts) in preparations containing 0.3% or less of total bifluorides.

(b) by inserting after paragraph (c) in item 5034 the following:

Boron trifluoride in preparations containing 0.1% or less of boron trifluoride (BF3).

8.    Schedule 6 amended (Agricultural and Industrial Poisons)

Schedule 6 to the Principal Order is amended as follows:

(a) by inserting after item 6042 the following:

Bifluorides (including ammonium, potassium and sodium salts) in preparations containing 3% or less of total bifluorides except when included in Schedule 5 .

(b) by omitting item 6045 and substituting the following:

Boron trifluoride in preparations containing 1% or less of boron trifluoride (BF3) except when included in Schedule 5 .

(c) by omitting item 6117 and substituting the following:

6117.	Deltamethrin –
	(a) in aqueous preparations containing 25% or less of deltamethrin, when no organic solvent, other than 10% or less of a glycol, is present; or
	(b) in wettable granular preparations containing 25% or less of deltamethrin; or
	(c) in water-dispersible tablets each containing 500mg or less of deltamethrin; or

(d) by omitting item 6224 and substituting the following:

(g) by inserting after subparagraph (ii) in paragraph (b) of item 6333 the following:

6333M.	Potassium nitrite in preparations containing 40% or less of potassium nitrite except –
	(a) when included in Schedule 5 ; or
	(b) in preparations containing 0.5% or less of potassium nitrite; or
	(c) when present as an excipient in preparations for therapeutic use; or
	(d) in aerosols containing 2% or less of potassium nitrite.

(h) by omitting item 6365 and substituting the following:

6365.	Selenium –
	(a) in preparations containing 2.5% or less of selenium when packed and labelled –
	(i) for the blueing of gun barrels; or
	(ii) for photographic purposes; or
	(iii) for the colouring of lead or lead alloys; or
	(b) in coated granules containing 1% or less of selenium for application to pasture except in fertilisers containing 200g/tonne or less of selenium; or
	(c) for the treatment of animals –
	(i) in a drench, injection, paste, stock lick or vaccine containing 0.5% or less of selenium; or
	(ii) in animal feed premixes containing 2% or less of selenium for the preparation of feeds containing 1g/tonne or less of selenium; or
	(iii) in controlled-release bolus preparations containing 25mg or less of selenium with a release rate not greater than 0.25mg/day; or
	(iv) as barium selenate in preparations for injection containing 5% or less of selenium.

9.    Schedule 7 amended (Dangerous Poisons)

Part 1 of Schedule 7 to the Principal Order is amended as follows:

(a) by inserting after item 7002 the following:

Acibenzolar-s-methyl.

(b) by inserting after paragraph (b) in item 7025 the following:

7025E.

Bifluorides (including ammonium, potassium and sodium salts) except when included in Schedule 5 or 6 .

(c) by inserting after item 7026 the following:

Boron trifluoride except when included in Schedule 5 or 6 .

(d) by omitting item 7063 and substituting the following:

7063.	Cyanides, metallic, except –
	(a) ferricyanides; or
