Poisons Amendment (Optometrists) Regulations 2002

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

1.   Short title

These regulations may be cited as the Poisons Amendment (Optometrists) Regulations 2002 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Poisons Regulations 1975 are referred to as the Principal Regulations.

4.   Regulation 3 amended (Interpretation)

Regulation 3 of the Principal Regulations is amended as follows:
(a) by inserting after the definition of "approved recording system" the following definition:
authorised optometrist means a person who is authorised under Division 3A of Part 3 of the Optometrists Registration Act 1994 to prescribe a restricted substance;
(b) by inserting after the definition of "nurse" the following definition:
optometrist means a person who is registered as an optometrist under the Optometrists Registration Act 1994 ;

5.   Regulation 31 amended (Storage of poisons, &c.)

Regulation 31(1A) of the Principal Regulations is amended by inserting "or an optometrist" after "surgeon".

6.   Regulation 31A amended (Advertising of restricted substances to public prohibited)

Regulation 31A of the Principal Regulations is amended by inserting ", optometry" after "veterinary".

7.   Regulation 32 amended (Prescriptions for restricted substances)

Regulation 32 of the Principal Regulations is amended as follows:
(a) by inserting in subregulation (1) "or an authorised optometrist" after "surgeon";
(b) by inserting in subregulation (2) "or an authorised optometrist" after "surgeon";
(c) by omitting from subregulation (2)(b)(i) "or veterinary surgeon" and substituting ", veterinary surgeon or authorised optometrist";
(d) by omitting subparagraph (iii) of paragraph (c) of subregulation (2) and substituting the following paragraphs:
(iii) by a veterinary surgeon for use in the course of animal treatment only and is endorsed in print with the words "For animal treatment only"; or
(iv) by an authorised optometrist, for use in the course of optometrical treatment only;
(e) by omitting from subregulation (2)(d) "or veterinary surgeon" and substituting ", veterinary surgeon or authorised optometrist";
(f) by inserting in subregulation (2AA) "or an authorised optometrist" after "surgeon" first occurring;
(g) by omitting from subregulation (2AA) "or veterinary surgeon" and substituting ", veterinary surgeon or authorised optometrist";
(h) by inserting in subregulation (2A)(a) "or an authorised optometrist" after "practitioner";
(i) by inserting in subregulation (2B) "or an authorised optometrist" after "practitioner";
(j) by inserting in subregulation (2B)(b) "or an authorised optometrist" after "practitioner".

8.   Regulation 32AA amended (Emergency prescribing and dispensing of restricted substances)

Regulation 32AA of the Principal Regulations is amended as follows:
(a) by inserting in subregulation (1) "or an authorised optometrist" after "dentist";
(b) by inserting in subregulation (2) "or an authorised optometrist" after "dentist".

9.   Regulation 33 amended (Sale or supply of restricted substances)

Regulation 33 of the Principal Regulations is amended as follows:
(a) by omitting from subregulation (1) "or veterinary surgeon" and substituting ", veterinary surgeon or authorised optometrist";
(b) by omitting from paragraph (c) of subregulation (1) "treatment." and substituting "treatment; or";
(c) by inserting in subregulation (1) after paragraph (c) the following paragraph:
(d) by the authorised optometrist only for use in the course of optometrical treatment.
(d) by omitting from subregulation (2) "or veterinary surgeon" and substituting ", veterinary surgeon or optometrist".

10.   Regulation 56 amended (Labelling of dispensed medicines)

Regulation 56 of the Principal Regulations is amended as follows:
(a) by inserting in subregulation (1)(a) "or an authorised optometrist" after "surgeon";
(b) by omitting subparagraph (iii) of paragraph (c) of subregulation (1) and substituting the following subparagraphs:
(iii) by a veterinary surgeon so acting for the purposes of animal treatment; or
(iv) by an authorised optometrist so acting for the purposes of optometrical treatment –

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Poisons Regulations 1975 to prescribe circumstances in which optometrists may issue prescriptions for, and administer and supply, poisons and restricted substances.
