The trustees of the Tasmanian Museum make the following by-laws under the Tasmanian Museum Act 1950 .

PART 1 - Preliminary

1.   Short title

These by-laws may be cited as the Tasmanian Museum By-laws 2001 .

2.   Commencement

These by-laws take effect on 1 January 2002.

3.   Interpretation

In these by-laws –
Act means the Tasmanian Museum Act 1950 ;
authorised person means an employee authorised for the purpose of these by-laws;
employee means a person appointed or employed under section 4A of the Act;
Museum property means –
(a) the Tasmanian Museum or any part of the Tasmanian Museum; and
(b) any property or any part of any property conveyed or transferred to the trustees under section 5(1) of the Act; and
(c) any property in the care, control or possession of the trustees.
PART 2 - Care, control and management

4.   Closed areas

A person, without the consent of an authorised person, must not enter or remain in any area of the Museum property –
(a) that is closed; or
(b) to which limited access has been granted.
Penalty:  Fine not exceeding 20 penalty units.

5.   Directions

An authorised person may give a direction for the purpose of –
(a) regulating the behaviour or conduct of a person in the Museum property; or
(b) limiting the number of persons entering the Museum property; or
(c) closing any part of the Museum property; or
(d) excluding or ejecting from the Museum property a person the authorised officer reasonably believes to be under 10 years of age who is not accompanied by a person capable of effectively controlling that person; or
(e) ensuring compliance with these by-laws.

6.   Personal items

(1)  An authorised person is to place a notice at or near the entrance to the Museum property stating that any person entering the Museum property may be required to leave any personal items in a place specified in the notice for the duration of their visit.
(2)  If any personal items left in the Museum property remain unclaimed for 7 days, an authorised person is to deliver the personal item as soon as possible to the nearest police station.

7.   Identification or examination of items

(1)  A person may request an authorised person to examine or identify a specified item.
(2)  Upon receipt of an item from a person, an authorised person is to give that person notice in writing that, if the item is not collected within 30 days, an authorised person may –
(a) retain the item for the use of the Tasmanian Museum; or
(b) destroy, or dispose of, the item.

8.   Removal of persons

(1)  An authorised person may exclude or eject any person from the Museum property if satisfied on reasonable grounds that the person –
(a) appears to be under the influence of alcohol or drugs; or
(b) is acting in a manner that may offend, annoy, disturb or injure an authorised person or any other person; or
(c) is acting in a manner that may cause damage or is causing damage to the Museum property; or
(d) is obstructing an authorised person in the exercise of any power under these by-laws; or
(e) has committed or is committing an offence under these by-laws.
(2)  A person who is excluded or ejected must not –
(a) refuse to leave the Museum property; or
(b) fail to leave the Museum property; or
(c) re-enter the Museum property within 24 hours.
Penalty:  Fine not exceeding 20 penalty units.
PART 3 - Miscellaneous

9.   Offences

A person, unless authorised by an authorised person, must not –
(a) obstruct an authorised person in the exercise of any power under these by-laws; or
(b) eat or drink in the Museum property; or
(c) cause or allow any live animal belonging to that person or under that person's control to enter or remain in the Museum property; or
(d) affix or post a bill or notice to or upon the Museum property; or
(e) reproduce or attempt to reproduce by any means any exhibit or object in the Museum property; or
(f) touch or in any other way handle or interfere with any exhibit or object in the Museum property; or
(g) gamble in the Museum property; or
(h) sell or offer for sale any article; or
(i) have in his or her possession or control –
(i) a radio, tape-recorder or other device for making or reproducing sound; or
(ii) any article, substance or other thing an authorised person reasonably believes may cause damage to any fixture, chattel, exhibit or other object in the Museum property.
Penalty:  Fine not exceeding 20 penalty units.

10.   Parking vehicles

(1)  The trustees, by notice, may specify any instruction or condition relating to the parking or driving of vehicles in any part of the Museum property.
(2)  A notice is to be displayed in a prominent position in the Museum property.
(3)  A person must comply with a notice.
Penalty:  Fine not exceeding 2 penalty units.

11.   Publication and reproduction of exhibits

A person, without the consent of an authorised person, must not publish or commercially reproduce by any means any exhibit, object or other item in the possession or care of the trustees.
Penalty:  Fine not exceeding 20 penalty units.

12.   Name and address

(1)  An authorised person may require any person he or she reasonably believes to be contravening a provision of these by-laws to state his or her full name and current residential address.
(2)  A person must not refuse to comply with subclause (1) .
Penalty:  Fine not exceeding 20 penalty units.
(3)  A person must not give a false name or address.
Penalty:  Fine not exceeding 20 penalty units.

13.   Rescission

The Tasmanian Museum By-laws 1977 are rescinded.

These by-laws were made by the trustees of the Tasmanian Museum at a meeting held on 21 November 2001.

The common seal of the trustees of the Tasmanian Museum was affixed on 21 November 2001, in the presence of –

These by-laws –
(a) provide for the care, control and management of the Tasmanian Museum; and
