Electoral Amendment Regulations 2001

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Electoral Act 1985 .

1.   Short title

These regulations may be cited as the Electoral Amendment Regulations 2001 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Electoral Regulations 1985 are referred to as the Principal Regulations.

4.   Schedule 3 substituted

Schedule 3 to the Principal Regulations is rescinded and the following Schedule is substituted:

SCHEDULE 3 - Remuneration and allowances payable to electoral officers

Regulation 48

Returning officer (House of Assembly) –
For duties in connection with a contested election, the conduct of the scrutiny and the completion of duties relating to persons who fail to vote –
		$
(a)	a returning officer who carries out those duties under an agreement between the Australian Electoral Commission and the Electoral Office	nil
(b)	any other returning officer	9 532 each election
Clerk to returning officer (House of Assembly) –
For assistance to the returning officer in a contested election –
		$
(a)	a clerk who carries out that assistance under an agreement between the Australian Electoral Commission and the Electoral Office	nil
(b)	any other clerk	5 187 each election
Returning officer (Legislative Council) –
For duties in connection with a contested or an uncontested election –
		$
(a)	a returning officer who carries out those duties under an agreement between the Australian Electoral Commission and the Electoral Office	nil
(b)	any other returning officer –
	(i) payable half-yearly on 1 July and 1 January	393 a year
	(ii) for duties in connection with a contested election, the conduct of the scrutiny and the completion of duties in relation to persons who fail to vote	2 315 each election
	(iii) for duties in connection with a non-contested election	366 each election
Clerk to returning officer (Legislative Council) –
For assistance to the returning officer if the returning officer is not a member of the staff of the Electoral Office –
		$
(a)	a clerk who carries out that assistance under an agreement between the Australian Electoral Commission and the Electoral Office	nil
(b)	any other clerk	824 each election
Officer in charge of polling-booth –
For duties in connection with running a polling-booth, including preparation and return of material –
		$
(a)	3 issuing points or less	395 each election
(b)	4 – 7 issuing points	425 each election
(c)	8 – 15 issuing points	464 each election
(d)	16 or more issuing points	522 each election
(e)	other duties	19.24 an hour
Assistant to officer in charge of polling-booth –
		$
(a)	Polling-day duties	314 a day
(b)	Duties other than on polling-day	18.73 an hour
Poll clerks –
		$
(a)	Engaged for the scrutiny	265 a day
(b)	Not engaged for the scrutiny	199 a day
Polling-place liaison officer –
		$
(a)	Polling-day duties	425 a day
(b)	Duties other than on polling-day	19.24 an hour
Scrutiny assistant –
		$
Polling-day duties	60 a day
Electoral visitor –
		$
(a)	Electoral visitor	18.73 an hour
(b)	Assistant electoral visitor	16.49 an hour
Electoral officers –
A person appointed –
		$
(a)	as returning officer for complex elections; or
(b)	in charge of Hare Clark scrutiny sheet; or
(c)	in charge of scrutiny at a complex election or by-election; or
(d)	in charge of the tally room; or
(e)	in charge of a complex electoral operation	35.74 an hour
Electoral officers –
A person appointed for –
		$
(a)	scrutiny at an election or by-election; or
(b)	professional skills, trade or expertise; or
(c)	scanning cell supervision; or
(d)	electoral supervisory duties
	– first 8 hours Monday to Friday and first 4 hours Saturday	19.27 an hour
	– all hours in excess of 8 on Monday to Friday and all hours in excess of 4 on Saturday	25.09 an hour
	– all hours on Sundays and Public Holidays	33.46 an hour
Electoral officers –
A person appointed for any or all of the following duties:
		$
(a)	postal and pre-poll voting;
(b)	enquiry service;
(c)	keyboard and terminal operation;
(d)	tally room;
(e)	scrutiny;
(f)	general clerical assistance
	– first 8 hours Monday to Friday and first 4 hours Saturday	14.93 an hour
	– all hours in excess of 8 on Monday to Friday and all hours in excess of 4 on Saturday	19.47 an hour
	– all hours on Sundays and Public Holidays	25.96 an hour
Travelling expenses (other than for the return of election material) –
		$
(a)	Travel by public transport	actual fare reimbursed
(b)	If public transport is not available	55.80 cents per kilometre each way
(c)	If required to be away from home overnight	actual accommodation charge
Travelling expenses (for the return of election material) –
	$
If distance travelled exceeds 30 kilometres	55.80 cents per kilometre in excess of 30 kilometres each way

These regulations amend the Electoral Regulations 1985 by increasing the remuneration and allowances payable to electoral officers who carry out duties in relation to elections for the House of Assembly and the Legislative Council.
