Animal Welfare Amendment Regulations 2001

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Animal Welfare Act 1993 .

1.   Short title

These regulations may be cited as the Animal Welfare Amendment Regulations 2001 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Animal Welfare Regulations 1993 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3 of the Principal Regulations is amended as follows:
(a) by inserting the following definitions after the definition of Act :
baffle means a metal shield attached to, and protruding into, the inside lower front of a cage;
commission includes to sign any contract to purchase or lease;
(b) by omitting "Gallus gallus." from the definition of domestic fowl and substituting "Gallus gallus;";
(c) by inserting the following definition after the definition of domestic fowl :
NRA means the National Registration Authority for Agricultural and Veterinary Chemicals established by the Agricultural and Veterinary Chemicals (Administration) Act 1992 of the Commonwealth.

5.    Regulation 6 amended (Domestic fowls in cages)

Regulation 6 of the Principal Regulations is amended as follows:
(a) by omitting from subregulation (1)(c) "450 cm2 for each fowl" and substituting "550 cm2 for each fowl, including the floor area under the baffle";
(b) by inserting the following subregulation after subregulation (1) :
(1A)  Subregulation (1)(c) does not apply to a cage commissioned before 1 January 2001 if the floor area of the cage is less than 550 cm2 for each domestic fowl, including the floor area under the baffle.

6.    Schedule 1 substituted

Schedule 1 to the Principal Regulations is rescinded and the following Schedule is substituted:

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Animal Welfare Regulations 1993 by –
(a) increasing the floor area of cages for domestic fowls in certain circumstances; and
(b) updating references to prescribed animals and prescribed substances used for the control of those animals in Schedule 1 to those regulations.
