Traffic (Road Rules) Amendment (Vehicle Standards Consequential) Regulations 2001

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Traffic Act 1925 .

1.   Short title

These regulations may be cited as the Traffic (Road Rules) Amendment (Vehicle Standards Consequential) Regulations 2001 .

2.   Commencement

These regulations take effect on the day on which the Vehicle and Traffic Amendment (Vehicle Standards) Act 2001 commences.

3.   Principal Rules

In these regulations, the Traffic (Road Rules) Regulations 1999 are referred to as the Principal Rules.

4.    Rule 378 amended (Speed-limit near school buses)

Rule 378(2) of the Principal Rules is amended as follows:
(a) by omitting "regulation 75H (1) of the Traffic (Miscellaneous) Regulations 1968 " from the definition of school bus warning light and substituting "the Vehicle Standards";
(b) by omitting "regulation 75H (1) of the Traffic (Miscellaneous) Regulations 1968 " from the definition of school bus warning sign and substituting "the Vehicle Standards".

5.    Schedule 5 amended (Dictionary)

Clause 1 of Schedule 5 to the Principal Rules is amended by inserting after the definition of vehicle the following definition:
Vehicle Standards means the Vehicle and Traffic (Vehicle Standards) Regulations 2001 ;

6.    Schedule 6 amended (Jurisdictional qualifications)

Schedule 6 to the Principal Rules is amended as follows:
(a) by inserting the following clause after clause 2 in Division 1 of Part 2 :
2A.   Mechanical signalling device
A device is declared to be a mechanical signalling device for the Road Rules if it is an approved mechanical signalling device complying with the Vehicle Standards.
(b) by inserting in clause 3 of Division 1 of Part 2 "declared to be" after "is";
(c) by inserting in clause 8(1) of Division 1 of Part 2 "declared to be" after "vehicle is";
(d) by inserting in clause 8(2) of Division 1 of Part 2 "declared to be" after "vehicle is";
(e) by inserting in clause 10 of Division 1 of Part 2 "declared to be" after "vehicle is";
(f) by omitting from clause 2 of Part 3 "is a child restraining device within the meaning of Division 7 of Part VIII of the Traffic (Miscellaneous) Regulations 1968 ." and substituting "complies with Australian Standard AS 1754 and bears the Australian Standards Mark.".

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Road Rules by –
(a) updating some legislative references to ensure that the rules are compatible with the reforms effected by the Vehicle and Traffic Amendment (Vehicle Standards) Act 2001; and
(b) making minor corrections to some definitional provisions.
