Gas Pipelines (Sensitive Developments) Order 2001

I make the following order under the Gas Pipelines Act 2000 .

1.   Short title

This order may be cited as the Gas Pipelines (Sensitive Developments) Order 2001 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Interpretation

(1)  In this order,
the Act means the Gas Pipelines Act 2000 .
(2)  In this order, a reference to the diameter of the relevant pipeline is taken to be a reference to the diameter of a pipeline to be constructed in accordance with a permit granted under the Land Use Planning and Approvals Act 1993 on 31 August 2001.

4.   Sensitive developments

For the purposes of section 92 of the Act, a development of land is taken to be sensitive if it involves a congregation of people, whether temporary or permanent, such that an incident would or might cause a significant risk to human safety or health.

5.   Specific sensitive developments

Without limiting the generality of clause 4 , a development of land for any of the following purposes is taken to be sensitive:
(a) residential accommodation;
(b) child care centre;
(c) school or other educational centre;
(d) hospital, nursing home or aged care centre;
(e) industrial or commercial premises;
(f) mineral, stone or soil extraction;
(g) medical centre;
(h) any place of assembly, including but not limited to, a place used for a religious, sporting or recreational purpose;
(i) pleasure boat facility;
(j) retail premises used for the sale or supply of goods or services;
(k) service station;
(l) transport terminal;
(m) any facility used in connection with the sale or supply of gas or electricity;
(n) veterinary centre;
(o) warehouse;
(p) winery.

6.   Attenuation distances

For the purposes of section 92(2)(b) of the Act, the attenuation distance in respect of the developments specified in this order is a distance expressed in meters which is equivalent to the diameter of the relevant pipeline expressed in millimetres.

For the purposes of limiting potential impacts on public health and safety and damage to gas pipelines, this order prescribes developments considered to be sensitive and attenuation distances in respect of those developments.
