Environmental Management and Pollution Control (Waste Management) Amendment Regulations 2001

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Environmental Management and Pollution Control Act 1994 .

1.   Short title

These regulations may be cited as the Environmental Management and Pollution Control (Waste Management) Amendment Regulations 2001 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Environmental Management and Pollution Control (Waste Management) Regulations 2000 are referred to as the Principal Regulations.

4.    Regulation 6 amended (General responsibilities)

Regulation 6 of the Principal Regulations is amended by inserting after subregulation (2) the following penalty:
Penalty:  Fine not exceeding 20 penalty units.

5.    Regulation 11 amended (Prohibited activities at facilities)

Regulation 11 of the Principal Regulations is amended by inserting after subregulation (3) the following penalty:
Penalty:  Fine not exceeding 50 penalty units.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Environmental Management and Pollution Control (Waste Management) Regulations 2000 to provide penalties in respect of –
(a) a failure to manage controlled waste in accordance with a National Management Plan or a national environment protection measure; and
(b) setting fire to, or burning, waste in certain circumstances.
