Traffic (Miscellaneous) Amendment (Wheeled Recreational Devices and Wheeled Toys) Regulations 2001

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Traffic Act 1925 .

1.   Short title

These regulations may be cited as the Traffic (Miscellaneous) Amendment (Wheeled Recreational Devices and Wheeled Toys) Regulations 2001 .

2.   Commencement

These regulations take effect on 1 July 2001.

3.   Principal Regulations

In these regulations, the Traffic (Miscellaneous) Regulations 1968 are referred to as the Principal Regulations.

4.   Regulation 101 amended (Offences)

Regulation 101 of the Principal Regulations is amended by omitting subregulations (2) and (3).

5.   Schedule 3A amended (Traffic Infringement Notices)

Part 2 of Schedule 3A to the Principal Regulations is amended as follows:
(a) by omitting from item 246 "on/in" and substituting "in/on";
(b) by inserting in item 247 "(other than in/on wheeled recreational device)" after "road";
(c) by inserting in item 248 "(other than in/on wheeled recreational device)" after "road";
(d) by omitting item 250;
(e) by inserting the following items after item 250:

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations –
(a) prescribe new traffic infringement notice offences relating to cyclists and the users of wheeled recreational devices (such as rollerblades, skateboards and scooters); and
(b) rescind obsolete traffic infringement notice offences, and other offence provisions, relating to those and certain other matters; and
(c) make corrections to the schedule of traffic infringement notice offences by way of statute law revision.
