Traffic (Road Rules) Amendment (Wheeled Recreational Devices and Wheeled Toys) Regulations 2001
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Traffic Act 1925 .

These regulations may be cited as the Traffic (Road Rules) Amendment (Wheeled Recreational Devices and Wheeled Toys) Regulations 2001 .
These regulations take effect on 1 July 2001.
In these regulations, the Traffic (Road Rules) Regulations 1999 are referred to as the Principal Rules.
4. Rule 355 amended (Seizure of vehicles)
Rule 355 of the Principal Rules is amended by omitting paragraph (b) .
5. Rules 371A , 371B , 371C , 371D and 371E inserted
After rule 371 of the Principal Rules , the following rules are inserted in Division 4:371A. No wheeled devices zones
(1) A person must not travel in or on a wheeled recreational device or wheeled toy in a no wheeled devices zone.
Penalty: Fine not exceeding 5 penalty units.
Note 1: Wheeled recreational device and wheeled toy are defined in the dictionary and no wheeled devices zone is defined in subrule (2) .
Note 2: This rule qualifies rule 240(2) and (3) .
(2) A no wheeled devices zone is (a) a length of footpath or other road-related area beginning at a no wheeled devices zone sign and ending at whichever of the following next appears or occurs beyond the sign:(i) an end no wheeled devices zone sign;(ii) the footpath or road-related area meets a road or intersection;(iii) the footpath or road-related area ends; or(b) an area with (i) a no wheeled devices zone sign on each footpath or other road-related area leading into the area; and(ii) an end no wheeled devices zone sign on each footpath or other road-related area leading out of the area; or(c) any part of the footpath or other road-related area that has a no wheeled devices zone road marking.
Note: Road is defined in rule 12, road-related area is defined in rule 13 and footpath and intersection are defined in the dictionary.
(3) In this rule,no wheeled devices zone road marking means a road marking consisting of a skateboard symbol and a scooter symbol inside a circle having a diagonal bar, the symbols and the circle with the diagonal bar being in a colour that contrasts with the colour of the road.
Note: Road marking is defined in the dictionary.
371B. Children under 12 not to use wheeled recreational devices or toys on roads
(1) A child who is under 12 years old must not do either of the following on a road:(a) travel in or on a wheeled recreational device;(b) travel in or on a wheeled toy.
Penalty: Fine not exceeding 5 penalty units.
Note 1: Road is defined in rule 12 and wheeled recreational device and wheeled toy are defined in the dictionary.
Note 2: This rule qualifies rule 240(2) and (3) .
(2) In this rule,road does not include a road-related area, but includes any shoulder of the road.371C. Wheeled recreational devices not to be used on roads at night
(1) A person must not travel in or on a wheeled recreational device on a road at night.
Penalty: Fine not exceeding 5 penalty units.
Note 1: Night and wheeled recreational device are defined in the dictionary.
Note 2: This rule qualifies rule 240(2)(b) .
(2) In this rule,road does not include a road-related area, but includes any shoulder of the road.371D. Wheeled recreational devices not to be used on roads with speed-limit over 60 km/h
(1) A person must not travel in or on a wheeled recreational device on (a) a length of road to which a speed-limit sign applies if the number on the sign is over 60; or(b) a length of road to which a default speed-limit greater than 60 kilometres per hour applies.
Penalty: Fine not exceeding 5 penalty units.
Note 1: Default speed-limits are dealt with in rule 25 , length of road and wheeled recreational device are defined in the dictionary and speed-limit signs are dealt with in Part 3 .
Note 2: This rule is related to the rules in Division 2 of Part 14 .
(2) In this rule,road does not include a road-related area, but includes any shoulder of the road.371E. Travelling in or on wheeled recreational device or toy without due care, &c.
A person must not travel in or on a wheeled recreational device or wheeled toy on a road without (a) due care and attention; or(b) reasonable consideration for other road users.
Penalty: Fine not exceeding 5 penalty units.
Note 1: Wheeled recreational device and wheeled toy are defined in the dictionary and road is defined in rule 12 .
Note 2: This rule is related to the rules in Division 2 of Part 14 .
6. Rule 376 rescinded
Rule 376 of the Principal Rules is rescinded.
7. Rule 390 substituted
Rule 390 of the Principal Rules is rescinded and the following rule is substituted:Rule 361 expires on 1 July 2001.
8. Schedule 5 amended (Dictionary)
Clause 1 of Schedule 5 to the Principal Rules is amended as follows:(a) by omitting "one" from the definition of bicycle and substituting "2";(b) by omitting ", scooter, tricycle and unicycle" from paragraph (a) of the definition of bicycle and substituting "and tricycle";(c) by inserting ", a scooter, a unicycle" after "skateboard" in paragraph (a) of the definition of wheeled recreational device .

EXPLANATORY NOTE
(This note is not part of the regulation)
These regulations (a) prescribe the restrictions and qualifications that are to apply to the use of wheeled recreational devices and toys (such as rollerblades, skateboards and scooters) on roads and paths once the provisions of the national road rules that generally permit such use come into effect in this State on 1 July 2001; and(b) remove the temporary Tasmanian prohibition on cyclists and animal riders using footpaths; such use is generally permitted under the national road rules; and(c) provide for the continuation, beyond 1 July 2001, of certain road rules that were to have expired on that date.
