Crime (Confiscation of Profits) Amendment Regulations 2001

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Crime (Confiscation of Profits) Act 1993 .

1.   Short title

These regulations may be cited as the Crime (Confiscation of Profits) Amendment Regulations 2001 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Crime (Confiscation of Profits) Regulations 1993 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3 of the Principal Regulations is amended as follows:

(a) by omitting " Crimes (Confiscation of Profits) Act 1989 " from the definition of Queensland Act and substituting " Crimes (Confiscation) Act 1989 ";

(b) by omitting " Crimes (Confiscation of Profits) Act 1986 " from the definition of Victorian Act and substituting " Confiscation Act 1997 ";

(c) by omitting " Crimes (Confiscation of Profits) Act 1988 " from the definition of West Australian Act and substituting " Criminal Property Confiscation Act 2000 ".

5.    Regulation 5 amended (Interstate forfeiture order)

Regulation 5 of the Principal Regulations is amended as follows:

(a) by omitting from paragraph (d) "section 8" and substituting "section 23";

(b) by omitting from paragraph (f) "section 7" and substituting "section 33 or 38";

(c) by omitting from paragraph (g) "section 10" and substituting "section 22, 28 or 30".

6.    Regulation 6 amended (Interstate pecuniary penalty order)

Regulation 6 of the Principal Regulations is amended as follows:

(a) by omitting from paragraph (d) "section 13" and substituting "section 34";

(b) by omitting from paragraph (e) "section 12" and substituting "section 59 or 64";

(c) by omitting from paragraph (f) "section 15" and substituting "section 12, 16, 17 or 22".

7.    Regulation 7 amended (Interstate restraining order)

Regulation 7 of the Principal Regulations is amended as follows:

(a) by omitting from paragraph (d) "section 17 or 19" and substituting "section 40 or 45";

(b) by omitting from paragraph (f) "section 16" and substituting "section 14 or 18";

(c) by omitting from paragraph (g) "section 20" and substituting "section 43".
