Poisons List Amendment Order 2001

I make the following order under section 14 of the Poisons Act 1971 .

1. Short title

This order may be cited as the Poisons List Amendment Order 2001 .

2. Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3. Principal Order

In this order, the Poisons List Order 1998 is referred to as the Principal Order.

4. Schedule 2 amended (Medicinal Poisons)

Schedule 2 to the Principal Order is amended as follows:
(a) by inserting after item 2019 the following:

2019A.
Carbocisteine.
(b) by omitting items 2066 and 2066E and substituting the following:

2066.
Isosorbide dinitrate in oral preparations containing 10mg or less of isosorbide dinitrate per dosage unit.
(c) by omitting item 2072 and substituting the following:

Loperamide in preparations for oral use in packs of 20 dosage units or less.

5. Schedule 3 amended (Potent Substances)

Schedule 3 to the Principal Order is amended as follows:
(a) by omitting item 3005M and substituting the following:

Beclomethasone in aqueous nasal sprays delivering 50 micrograms or less of beclomethasone per actuation when the maximum recommended daily dose is no greater than 400 micrograms and when packed in a primary pack containing 200 actuations or less, for the short-term prophylaxis or treatment of seasonal allergic rhinitis in adults and children 12 years and over.
(b) by omitting item 3008E and substituting the following:

(b) in preparations containing 5% or less of glycolic acid; or

(c) in preparations containing 20% or less of glycolic acid with a pH of 3.5 or greater.
(i) by omitting item 6225 and substituting the following:

Lead compounds except –

(a) when included in Schedule 4 or 5 ; or

(b) in zinc-based paints or tinters containing 0.2% or less of lead as an impurity in the zinc and calculated on the non-volatile content of the paint or tinter; or

(a) IRRITANT;

(b) REPEATED EXPOSURE MAY CAUSE SENSITISATION;

(c) AVOID CONTACT WITH EYES;

(d) AVOID CONTACT WITH SKIN;

(e) WEAR PROTECTIVE GLOVES WHEN MIXING OR USING;

(f) ENSURE ADEQUATE VENTILATION WHEN USING.
(l) by omitting item 6292 and substituting the following:

Phenylenediamines and alkylated phenylenediamines not specified in Schedule 1 , 2 , 3 , 4 , 5 , 7 or 8 –

(a) in preparations packed and labelled for photographic purposes; or

(b) in preparations packed and labelled for testing water except tablets containing 10mg or less of diethyl-para-phenylenediamine or dimethyl-para-phenylenediamine in opaque strip packaging, provided the directions for use include the statement: DO NOT DISCARD TESTING SOLUTIONS INTO THE POOL; or

(c) in hair dyes except when the immediate container and primary pack are labelled with the following statements, in letters not less than 1.5mm in height:

(i) KEEP OUT OF REACH OF CHILDREN;

(ii) WARNING – THIS PRODUCT CONTAINS INGREDIENTS WHICH MAY CAUSE SKIN IRRITATION TO CERTAIN INDIVIDUALS. A PRELIMINARY TEST ACCORDING TO THE ACCOMPANYING DIRECTIONS SHOULD BE MADE BEFORE USE. THIS PRODUCT MUST NOT BE USED FOR DYEING EYELASHES OR EYEBROWS; TO DO SO MAY BE INJURIOUS TO THE EYE.
(m) by inserting after item 6321 the following:

Pyrithione zinc except when included in –

(a) Schedule 2 ; or

(b) semi-solid hair preparations; or

(c) shampoos containing 2% or less of pyrithione zinc.
(n) by omitting item 6331 and substituting the following:

Selenium –

(a) in preparations containing 2.5% or less of selenium when packed and labelled –

(i) for the blueing of gun barrels; or

(ii) for photographic purposes; or

(iii) for the colouring of lead or lead alloys; or

(b) in coated granules containing 1% or less of selenium for application to pasture except in fertilisers containing 200g/tonne or less of selenium; or

(c) in a drench, injection, paste, stock lick, vaccine or horse feed supplement containing 0.5% or less of selenium for the treatment of animals; or

(d) in animal feed premixes containing 2% or less of selenium when packed and labelled for the preparation of feeds containing 1g/tonne or less of selenium; or

(e) in controlled-release bolus preparations containing 25mg or less of selenium with a release rate not greater than 0.25mg/day for the treatment of animals.
(o) by omitting item 6368 and substituting the following:

Toluenediamine when included in hair dyes except when the immediate container and primary pack are labelled with the following statements, written in letters not less than 1.5mm in height:

(a) KEEP OUT OF REACH OF CHILDREN;

(b) WARNING – THIS PRODUCT CONTAINS INGREDIENTS WHICH MAY CAUSE SKIN IRRITATION TO CERTAIN INDIVIDUALS. A PRELIMINARY TEST ACCORDING TO THE ACCOMPANYING DIRECTIONS SHOULD BE MADE BEFORE USE. THIS PRODUCT MUST NOT BE USED FOR DYEING EYELASHES OR EYEBROWS; TO DO SO MAY BE INJURIOUS TO THE EYE.

9. Schedule 7 amended (Dangerous Poisons)

Schedule 7 to the Principal Order is amended as follows:
(a) by inserting after item 7152 the following:

(b) by omitting item 7195 and substituting the following:

Selenium except –

(a) when included in Schedule 6 ; or

(b) as selenium arsenide in photocopier drums; or

(c) in preparations for therapeutic use other than –

(i) drench concentrates containing 2.5% or less of selenium; or

(ii) pour-on preparations containing 0.5% or less of selenium; or

(d) in paints or tinters containing 0.1% or less of selenium calculated on the non-volatile content of the paint or tinter; or

This order amends the Poisons List Order 1998 to incorporate changes recommended by the National Drugs and Poisons Schedule Committee.

3058.	Triamcinolone acetonide –
	(a) for the treatment of mouth ulcers, in preparations containing 0.1% or less of triamcinolone acetonide in a pack of 5g or less; or
