Inland Fisheries (Recreational Fishing) Amendment Regulations (No. 5) 2000

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Inland Fisheries Act 1995 .

1.   Short title

These regulations may be cited as the Inland Fisheries (Recreational Fishing) Amendment Regulations (No. 5) 2000 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Inland Fisheries (Recreational Fishing) Regulations 1999 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3 of the Principal Regulations is amended as follows:
(a) by inserting the following definition after the definition of bream :
brown trout means the species Salmo trutta of the family Salmonidae;
(b) by inserting the following definition after the definition of possession :
rainbow trout means the species Oncorhynchusmykiss of the family Salmonidae;

5.    Regulation 15 amended (Minimum sizes of fish)

Regulation 15 of the Principal Regulations is amended as follows:
(a) by omitting from subregulation (1)(f) "length." and substituting "length; or";
(b) by inserting the following paragraphs after paragraph (f) in subregulation (1) :
(g) any salmon that is less than 420 millimetres in length from the following waters:
(i) First Lagoon;
(ii) Rocky Lagoon;
(iii) Carter Lake;
(iv) Carter Lagoons;
(v) Lake Botsford;
(vi) East Rocky Lagoon; or
(h) any rainbow trout from Penstock Lagoon that is less than 220 millimetres in length; or
(j) any brown trout from Penstock Lagoon that is less than 420 millimetres in length.
(c) by omitting subregulation (2) and substituting the following subregulation:
(2)  Subregulation (1)(a) does not apply to –
(a) a person who takes fish in State waters that are not excepted waters; or
(b) any salmon in the following waters:
(i) First Lagoon;
(ii) Rocky Lagoon;
(iii) Carter Lake;
(iv) Carter Lagoons;
(v) Penstock Lagoon;
(vi) Lake Botsford;
(vii) East Rocky Lagoon.

6.    Regulation 16 amended (Bag limits)

Regulation 16(3) of the Principal Regulations is amended by omitting paragraph (k) and substituting the following paragraphs:
(k) Western Lakes, excluding First Lagoon, Second Lagoon, Rocky Lagoon, East Rocky Lagoon, Carter Lake, Carter Lagoons and Lake Botsford, – 5;
(l) First Lagoon  – 1;
(m) Second Lagoon  – 1;
(n) Rocky Lagoon  – 2;
(o) East Rocky Lagoon  – 0;
(p) Carter Lake  – 2;
(q) Carter Lagoons  – 2;
(r) Lake Botsford  – 2.

7.    Regulation 16A inserted

After regulation 16 of the Principal Regulations , the following regulation is inserted in Part 2:

16A.   Take and release

(1)  Regulation 16(3)(b) does not apply if a person immediately releases the salmon back into the waters of Lagoon of Islands immediately after taking it from those waters.
(2)  Regulation 16(3)(g) does not apply if a person immediately releases the salmon back into the waters of Little Pine Lagoon immediately after taking it from those waters.
(3)  Regulation 16(3)(j) does not apply if a person immediately releases the salmon back into the waters of Penstock Lagoon immediately after taking it from those waters.
(4)  Paragraphs (k), (l), (m), (n), (o), (p), (q) and (r) of regulation 16(3) do not apply if a person immediately releases the salmon back into the waters referred to in those paragraphs, other than the waters of Lake Mackenzie and Lake Augusta, immediately after taking it from those waters.

8.    Regulation 21 amended (Use of baits and lures)

Regulation 21 of the Principal Regulations is amended as follows:
(a) by omitting paragraph (x) from subregulation (2) and substituting the following paragraph:
(x) Carter Lake;
(b) by omitting paragraph (z) from subregulation (2) and substituting the following paragraph:
(z) any waters in a world heritage area, other than East Rocky Lagoon, Lake Augusta, Lake Mackenzie, Rocky Lagoon, Second Lagoon and Carter Lagoons.
(c) by omitting from subregulation (3)(h) "canals." and substituting "canals;";
(d) by inserting the following paragraphs after paragraph (h) in subregulation (3) :
(i) East Rocky Lagoon;
(j) Rocky Lagoon;
(k) Second Lagoon.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Inland Fisheries (Recreational Fishing) Regulations 1999 by making further provisions relating to –
(a) the minimum sizes of fish; and
(b) bag limits for certain fish in certain waters; and
(c) the use of baits and lures.
